Hearing 03-14-2001 License Transfer
PUBLIC HEARING of the Town Council held Wednesday, March 14, 2001 at 7:10 p.m. in the Council Chamber, Town Building, Harrisville for and within the Town of Burrillville.

MEMBERS PRESENT:  Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

MEMBERS ABSENT:  None

The application for transfer to sell beverages under Title 3, Chapter 5, Section 17 and Title 3, Chapter 5, Section 19 of the General Laws of Rhode Island, 1956, and amendments thereto, [Class B(V)] has been made as follows:

FROM:   Gus' Red Tavern Restaurant Inc., in building owned by John R. Duguay and A. Emma Duguay, for premises located at 2692 Victory Highway, Nasonville (Assessors Map 114, Lot No. 4).

TO:     Mottola Enterprises, Inc. d/b/a Gus Red Tavern, in building owned by John R. Duguay and A. Emma Duguay, for premises located at 2692 Victory Highway, Nasonville (Assessors Map 114, Lot No. 4).

NOTE:  The above was duly advertised in the Legal Section of the Woonsocket Call on Monday February 26, 2001 and Monday, March 5, 2001.


VOTED that the report from Colonel Bernard E. Gannon, Chief of Police, be received.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William A. Andrews.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

VOTED to approve, subject to receipt of the Certificate of Good Standing in accordance with Title 3, Chapter 7, Section 24 of the General Laws of the State of Rhode Island, 1956, as amended, “Certificate of Good Standing”, as submitted by the Rhode Island Division of Taxation.

Motion by Councilor William A. Andrews.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

VOTED that the report of the Building Inspector be received.

Motion by Councilor Louis Bleiweis.  Seconded by Councilor William E. Gonyea.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

VOTED to approve, subject to the receipt of the report of the health inspector.

Motion by Councilor William A. Andrews.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

VOTED to grant, subject to receipt of the report of the fire inspector.

Motion by Councilor Louis Bleiweis.  Seconded by Councilor William E. Gonyea.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

The hearing of all interested parties in regard to the granting of this license:

Councilor Norman C. Mainville stated his pleasure that Gus would continue and that this business is an asset to the eastern end of Town, making it the food-hub of the Town of Burrillville.

        b)      Opponents:  None

Note:  Persons who wish to address the Town Council shall state their name and address.

VOTED that the application for transfer of the Class B(V) license be granted subject to receipt of the Certificate of Good Standing, the report of the health inspector and the report of the fire inspector.

Motion by Councilor William A. Andrews.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

VOTED to adjourn at 7:15 p.m.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Information relating to the public hearing is on file with the record of the minutes.  The hearing was taped and the tape is on file with the record of the minutes.
