11-17-2003 Special Meeting - Liquor License Renewals
SPECIAL MEETING of the Town Council held Monday, November 17, 2003 at 10:10 o’clock a.m. in the Council Chamber, Town Building, 105 Harrisville Main St., Harrisville for and within the Town of Burrillville.

MEMBERS PRESENT:  Council President Wallace F. Lees, Councilors Louis Bleiweis, Edward F. Bonczek, Ronald E. Faford and William E. Gonyea.

MEMBERS ABSENT:  Councilors Jacqueline Zahn and William A. Andrews were excused due to work commitments.

1.      Discussion and action on the following renewals of Alcoholic Beverage Licenses under provision of Title 3, Chapter 7, GENERAL LAWS of Rhode Island, 1956, as amended, for the period beginning December 1, 2003 and ending November 30, 2004, subject to

·       Obtaining a Certificate of Good Standing from the State Division of Taxation prior to the date of said renewal, and
·       The payment of taxes owed to the Town of Burrillville, and
·       The establishment being in compliance with all state and local building and fire codes.
·       Copy of certification from the Rhode Island Department of Health.

NOTE:  Notice of the Special Meeting was duly advertised in the Legal Section of the Woonsocket Call on Friday, November 7, 2003 and Friday, November 14, 2003.  

Before the Town Council considered the applications, the Town Clerk, reviewed concerns voiced by Michael C. Wood, Town Manager, during the administrative review.  Several businesses indicate that they do not have workers’ compensation insurance and/or general liability insurance.  It was recommended that those entities that do not have workers’ compensation insurance should be asked to provide evidence that they are not required under State law to carry that insurance.  It was further recommended that those businesses that do not carry general liability insurance might be advised that they should consider this coverage, and that the Town’s insurance carrier be notified of the licenses issued.  Walter J. Kane, Town Solicitor, described his research relative to the Town’s ability to require insurance.  He stated that, in his opinion, the Town could not require liability insurance as a condition of granting victualing and/or liquor licenses.

Motion by Councilor Edward F. Bonczek.  Seconded by Councilor Ronald E. Faford.  The vote was unanimous by the five members present.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Louis Bleiweis, Edward F. Bonczek, Ronald E. Faford and William E. Gonyea. Councilors Jacqueline Zahn and William A. Andrews were excused.

Faford.  The motion carried, four in favor, one recusal, two excused.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Louis Bleiweis, Edward F. Bonczek and Ronald E. Faford.  Councilor William E. Gonyea recused. Councilors Jacqueline Zahn and William A. Andrews were excused.

Motion by Councilor Ronald E. Faford.  Seconded by Councilor Edward F. Bonczek.  The vote was unanimous by the five members present.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Louis Bleiweis, Edward F. Bonczek, Ronald E. Faford and William E. Gonyea. Councilors Jacqueline Zahn and William A. Andrews were excused.

VOTED that the Class B (Victualer) and Class D (Full Privilege Liquor Licensees), be and they are hereby granted permission to remain open until 3:00 o’clock a.m. on New Year’s Day January 1, 2004 and no intoxicating liquor shall be sold after 2:00 o’clock a.m. until the legal opening hours of January 1, 2004 and no dancing shall be permitted after 3:00 o’clock a.m. on New Year’s morning until the legal opening hour.  Licensees who plan to remain open must notify the Chief of Police, Colonel Bernard E. Gannon on or before December 2, 2003.

Motion by Councilor Louis Bleiweis.  Seconded by Councilor William E. Gonyea.  The vote was unanimous by the five members present.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Louis Bleiweis, Edward F. Bonczek, Ronald E. Faford and William E. Gonyea. Councilors Jacqueline Zahn and William A. Andrews were excused.
