SPECIAL MEETING of the Town Council of the Town of Burrillville held Monday, November 22, 2004 at 1:05 p.m. in the Burrillville Town Council Chambers, Town Building, 105 Harrisville Main Street, Harrisville.
MEMBERS PRESENT: Council President Wallace F. Lees; Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, Ronald E. Faford and William E. Gonyea.
MEMBERS ABSENT: None
Note: Council President Wallace F. Lees indicated that items would be taken out of order.
2. VOTED to receive and open the criteria for determining gross household income for eligibility to receive tax credits; for consideration and discussion.
Motion by Councilor Jacqueline Zahn. Seconded by Councilor William E. Gonyea. The motion was unanimous by the six members present. Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, Louis Bleiweis, Edward F. Bonczek, Ronald E. Faford and William E. Gonyea. Councilor William A. Andrews had not arrived at the time the vote was taken.

Discussion: Walter J. Kane, Town Solicitor, explained that the ordinance subcommittee and the tax assessor had been developing criteria for determining gross household income for eligibility to receive tax credits. Mr. Kane explained that residents who want an increased tax credit due to their income would have to complete an application. Mr. Kane reviewed the ordinance that provides for this credit.
Walter J. Kane, Town Solicitor, briefly discussed the associated legislation that provides a tax credit for residents determined to be totally disabled, explaining that the Town Council could, under this legislation, adopt an ordinance for disabled resident ineligible for social security, with eligibility determined through a process established by the ordinance. This process, he said, is still being developed.
James R. Drew, Tax Assessor, submitted a proposed application to the Town Council for their review. Mr. Drew briefly described the application and the correspondence that would be sent to the applicant. All residents who presently receive a tax credit, he said, would receive the application.
VOTED to continue to the first regular meeting to be held on December 8, 2004.

VOTED to open discussion of authorizing the administration to proceed with bidding of the school administration building project and to appropriate a sum of $500,000 from the major capital account; and that each construction phase be subject to Town Council approval; to be considered and acted on.
Motion by Councilor Jacqueline Zahn. Seconded by Councilor William E. Gonyea. The motion was unanimous. Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, Ronald E. Faford and William E. Gonyea.
VOTED that $323,706 be transferred from the Town’s Unreserved, Undesignated General Fund Balance to the Major Capital Fund.

1. Stainless Steel Spreaders (1)
VOTED to award the purchase of one (1) stainless steel spreader to J.J. Gregory & Son, Inc., at a cost of $8,450.
Motion by Councilor Jacqueline Zahn. Seconded by Councilor William A. Andrews.
Discussion: Richard A. Bernardo, P.E., Director of Public Works, indicated that this would result in the department having all stainless steel sanders. The budgeted amount of $16,000 was for two spreaders; however, since the bid exceeded the budget, only one spreader would be purchased. Mr. Bernardo indicated that one would suffice.
The motion was unanimous. Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, Ronald E. Faford and William E. Gonyea.
2. Bituminous Concrete Excavation by Cold Planer
Discussion: There was no bid for bituminous concrete excavation by cold planer. Richard A. Bernardo, P.E., Director of Public Works, indicated that the department has not used this item for several years, resulting in vendors not bidding. Mr. Bernardo suggested that if the item is needed, it could be rebid.
3. Hot Mix Bituminous Concrete Installation
A Furnish & Install Bituminous Concrete Type I-1 including tack coat (per ton)
VOTED to award the installation of hot mix bituminous concrete Type I-1, including tack coat, to J.H. Lynch & Sons, Inc. at the cost per ton of $40.58 (Year 1), $41.38 (Year 2), and $42.18 (Year 3).
Motion by Councilor Jacqueline Zahn. Seconded by Councilor Ronald E. Faford.
Discussion: Richard A. Bernardo, P.E., Director of Public Works, indicated that the price was competitive.

VOTED to award the installation of hot mix bituminous concrete modified binder course to J.H. Lynch & Sons, Inc., at the cost per ton of $39.78 (Year 1), $40.58 (Year 2), and $41.38 (Year 3).
Motion by Councilor Jacqueline Zahn. Seconded by Councilor Louis Bleiweis.
Discussion: Richard A. Bernardo, P.E., Director of Public Works, indicated that the amount for the first year was the same as the current year.

C Construct Cape Cod Berm (linear foot)
VOTED to award the installation of hot mix bituminous concrete modified binder course to J.H. Lynch & Sons, Inc. at the cost per linear foot of $1.17 (Year 1), $1.27 (Year 2), and $1.37 (Year 3).
Motion by Councilor Jacqueline Zahn. Seconded by Councilor Ronald E. Faford.
Discussion: Richard A. Bernardo, P.E., Director of Public Works, indicated that the item was seldom used. Mr. Bernardo said that the item was included should it be needed for particular projects.
The motion was unanimous. Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, Ronald E. Faford and William E. Gonyea.
