SPECIAL MEETING of the Town Council held Monday, November 21, 2005 at 10:00 o’clock A.M. in the Council Chamber, Town Building, 105 Harrisville Main St., Harrisville for and within the Town of Burrillville.

MEMBERS PRESENT: Council President Wallace F. Lees; Councilors William A. Andrews, Nancy F. Binns, Margaret L. Dudley, and William E. Gonyea.

1. That the following renewals of Alcoholic Beverage Licenses under provision of Title 3, Chapter 7, GENERAL LAWS of Rhode Island, 1956, as amended, for the period beginning December 1, 2005 and ending November 30, 2006.

VOTED to continue to the first meeting of February 2006 the question of alcohol service on decks as requested by AJAR, Inc. d/b/a Western Hotel, Mama McGee’s and Mark Murphy, Inc. d/b/a Georges at which time the Town Council will review the requests and decide whether to schedule public hearings.

2. VOTED that the Class B (Victualer) and Class D (Full Privilege) Liquor Licensees, be and they are hereby granted permission to remain open until 3:00 o’clock a.m. on New Year’s Day January 1, 2006 and no intoxicating liquor shall be sold after 2:00 o’clock a.m. until the legal opening hours of January 1, 2006 and no dancing shall be permitted after 3:00 o’clock a.m. on New Year’s morning until the legal opening hour. Licensees who plan to remain open must notify the Chief of Police, Colonel Bernard E. Gannon on or before November 30, 2005.

05-359 VOTED to receive and open the correspondence from Michael C. Wood, Town Manager, regarding his request that the Town Council vote to confirm approval of the tentative Police Collective Bargaining Agreement with IBPO, Local 369.

Discussion: Michael C. Wood, Town Manager, noted that the tentative Police Collective Bargaining Agreement with IBPO, Local 369, had been approved at the November 9, 2005 Council Meeting. Mr. Wood asked that the Town Council vote to confirm the approval of the agreement.

VOTED to ratify the police contract, with the understanding that any wage changes would be effective the payroll period ending November 27, 2005 and reflected in paychecks distributed December 2, 2005; also, modifications to the health insurance and conditions will become effective when the administration properly coordinates the transitions required to implement the changes.

05-360 VOTED to receive and open the correspondence from Richard A. Bernardo, P.E., Director of Public Works/Engineering, regarding required fire safety code improvements at the Department of Public Works facility, 65 Union Avenue.

Discussion: Michael C. Wood, Town Manager, described the fire safety code improvements that would be required at the public works facility at 65 Union Avenue, Harrisville and provided a $22,771 estimate of the cost to complete the improvements. Mr. Wood noted that he had submitted a request for a variance to allow time to complete the improvements. Mr. Wood said that there was money in the contingency fund for these improvements and suggested that some of the cost could be assessed to the users of the facility. The possibility of a voluntary participation was discussed.

VOTED to appropriate up to $25,000 from the contingency fund to install fire suppression system at the DPW garage; and that the fire and utility districts that get their gasoline at the DPW garage be assessed a portion of the cost; failure to pay would result in their not being able to get their gasoline through the Town.

05-361 VOTED to grant the request for Executive Session from Michael C. Wood, Town Manager, pursuant to Rhode Island Open Meeting Law [42-46-5 (a)(5)] for discussion and considerations related to the acquisition, sale or exchange of real property; and [42-46-5 (a)(2)] for review and discussions relating to litigation matters.
