11-28-05 Show Cause Hearing
SHOW CAUSE HEARING of the Town Council held Monday, November 28, 2005 at 7:00 o'clock p.m. in the Council Chamber, Town Building, Harrisville, for and within the Town of Burrillville.

MEMBERS PRESENT:  Council President Wallace F. Lees; Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.

MEMBERS ABSENT:  None

1.      The Town Council of the Town of Burrillville, Rhode Island, acting in their capacity as licensing commissioners for said Town, will hear evidence concerning complaints submitted by Colonel Bernard E. Gannon, Chief of Police of the Town of Burrillville in regards to the Class B Victualing Liquor License, numbered 2, which was granted on the 30th day of November 2004 and issued to Bolduc, Inc. d/b/a/ Maddog Saloon.

Council President Wallace F. Lees opened the hearing at 7:00 p.m. and turned the discussion to Walter J. Kane, Town Solicitor.

Walter J. Kane, Town Solicitor, read a memo that he had sent to the Town Council on November 28, 2005, as follows:

On November 15th a Show Cause Order was served and accepted by the owner of the Mad Dog Saloon.  He was requested to have his attorney contact this office as soon as possible.

John Quattrocchi III contacted the Police Department and arranged to see the tapes of the alleged misconduct on Wednesday, November 23, 2005.  Present at that meeting was Mr. Bolduc, his Manager, Mr. Quattrocchi, Mr. Bernstein the Assistant Solicitor, and the Police Chief.

On Thursday, November 24, 2005 (Thanksgiving Day) Mr. Quattrocchi faxed to Mr. Bernstein a request asking for a continuance because he was going to be out of the country from November 25, 2005 until December 1, 2005 (see attached).

This office had raised the issue of whether Mr. Quattrocchi was authorized to practice.  He is listed in the Rohde Island Supreme Court as “Inactive Paid”.  Under that status it is illegal to practice law.  On further inquiry, I received a communication from the Clerk’s Office that Mr. Quattrocchi can change his status to “Active” by going to the Clerk’s Office and paying a reinstatement fee of $275.00.

I suggest that the Council do the following:

1.      Continue the Show Cause Hearing to a date that is agreeable to the Council.

2.      Continue the existing license to the date of the Show Cause Hearing or the first meeting in January.

I suggest that the continuance be for at least ten (10) days.  I have attached documents received in connection with the matter.

Mr. Kane further suggested that the continuance of the present license be conditional upon Bolduc, Inc. getting the certificate of insurance and health department certification filed before December 1, 2005.  Michael C. Wood, Town Manager, added that a certificate of good standing must also be received in the office of the Town Clerk by December 1, 2005. Mr. Kane suggested that if the three documents were not received by December 1, 2005, the Town Clerk would notify the police department that Bolduc, Inc. d/b/a Mad Dog Saloon was not authorized to serve food or alcohol until the documentation had been received.

VOTED to continue the show cause hearing to January 11, 2006 at 6:00 p.m.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William A. Andrews.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.

VOTED to extend the present license until January 11, 2006, subject to receipt of a certificate of insurance, health department certification and a certificate of good standing.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William A. Andrews.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.

VOTED to continue this matter until January 11, 2006 at 6:00 p.m. in Town Council Chambers.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.
