10-11-2006 Town Council Regular Meeting
REGULAR MEETING of the Town Council held on Wednesday, October 11, 2006 at 7:40 p.m. in the Town Council Chambers, Town Building, 105 Harrisville Main St., Harrisville, for and within the Town of Burrillville.

MEMBERS PRESENT:  Council President Wallace F. Lees; Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

MEMBERS ABSENT:  None

        1.     Council President Wallace F. Lees led those present in pledging allegiance to the flag.

       2.      VOTED to accept the minutes of the regular meetings held August 23, 2006 and September 27, 2006; and the public hearings held September 27, 2006; and dispense with the reading of said minutes.

Motion by Councilor Nancy F. Binns.  Seconded by Councilor William A. Andrews.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

       3.     Public Comment:
        
Kevin Blais of 1738 Tarkiln Road congratulated the Bicentennial Commission on the parade, commended the Council and discussed his participation.  Mr. Blais discuss his radio campaign and recommended radio advertising of public service announcements.

David Ketcham of 760 Central Street addressed the Town Council relative to recent political advertising related to the library project.  Dr. Ketcham said that the advertisement contained many inaccuracies, i.e. a cost in excess of $10,000,000 while the cost is slated to be $8,852,064.  He said that: the advertisement inaccurately indicated that remediation had not been included in the cost; inaccurately states that the site is heavily contaminated; and contains a made-up cost of $12.6 million.  Dr. Ketcham reviewed anticipated costs and revenue for the library, stating that the net cost was approximately $2,000,000 - $2,500,000 rather than the $9,000,000 stated in the advertisement.  Dr. Ketcham spoke of the committee’s dedication.

       4.      General Good and Welfare

Councilor Nancy F. Binns commended the Bicentennial Committee for a wonderful job with the parade.

Councilor Nancy F. Binns encouraged participation in the Bicentennial Banquet scheduled for November 16, 2006.

        5.      Petitions:  None

        6.      Special Business:  

06-280  Presentation of the new economic development video by Keith Elliott.

VOTED to continue to the next meeting.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.

06-281  VOTED to open ratification of proclamation honoring Captain Walter Edward “Ted” Carter upon his appointment as the Commanding Officer of the USS Carl Vinson.

Motion by Councilor Nancy F. Binns.  Seconded by Councilor Jacqueline Zahn.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

Discussion:  Council President Wallace F. Lees invited Jeff Farrell to address the Town Council regarding Captain Walter Edward “Ted” Carter’s appointment as the Commanding Officer of the USS Carl Vinson.  Mr. Farrell of 231 South Main St. discussed the honor of attending the ceremonies during which Captain Carter, a Burrillville native, took command of the aircraft carrier USS Carl Vinson.  

VOTED to ratify.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Nancy F. Binns.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.  He discussed the many awards, commendations and accomplishments of Captain Carter.

VOTED to move item 06-284 forward on the agenda.

Motion by Councilor William A. Andrews.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

06-284  VOTED to open the correspondence from Michael C. Wood, Town Manager, regarding a voluntary program for town employees to send holiday greetings/ornaments to servicepeople.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

Discussion:  Michael C. Wood, Town Manager, asked that Edward Pienkos, Information Systems Manager, present his proposal for a voluntary program for town employees to send holiday greetings/ornaments to servicepeople.  Mr. Pienkos noted that many Burrillville residents serving in the Armed Forces are recognized on the Town’s website.  Mr. Pienkos suggested a program for town employees to send holiday greetings to these and perhaps additional residents serving in the military.  The matter was discussed.  Kevin Menard of Pascoag suggested that the Town Council might match employee contributions as an incentive.  Robert Marshall of Mapleville supported the program and offered to match employee contributions.  The Town Council voice support of Mr. Menards recommendation.

VOTED to support the proposition; with an incentive.

Motion by Councilor William A. Andrews.  Seconded by Councilor Ronald E. Faford.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.
        
06-282  VOTED to ratify a proclamation honoring Maureen N. Guilbault upon completion of 20 years of dedicated service as executive director of the Burrillville Housing Authority.

Motion by Councilor Nancy F. Binns.  Seconded by Councilor Ronald E. Faford.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

06-283  VOTED to grant a special event victualing license to the Calvary Episcopal Church for a holiday bazaar to be held on November 4 and November 11, 2006 in the Good Shepherd Hall (Assessor’s Map 174, Lot 24).

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Nancy F. Binns.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

        7.     Unfinished Business:  

06-258  VOTED to open the correspondence from Richard A. Bernardo, P.E., Director of Public Works and Engineering Services, regarding the reconstruction of Gazza Bridge; from Walter J. Kane, Town Solicitor, relative to funding the project; and from John P. Mainville, Finance Director, relative to funding options.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

Discussion:  There was discussion of the funding options, the reasons for the construction schedule and the possible impact on the undesignated, unreserved fund.

VOTED that the $85,000 be taken from the undesignated, unreserved fund.

Motion by Councilor William A. Andrews.  Seconded by Councilor Ronald E. Faford.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

8.     New Business:

06-284  Correspondence from Michael C. Wood, Town Manager, regarding a voluntary program for town employees to send holiday greetings/ornaments to servicepeople.

06-285  VOTED to open the correspondence from Wallace F. Lees, President, Burrillville Town Council, regarding the council meeting schedule for November and December 2006.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

VOTED to cancel the meetings scheduled for November 22, 2006 and December 27, 2006.

Motion by Councilor William A. Andrews.  Seconded by Councilor Ronald E. Faford.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. 06-286  VOTED to open the correspondence from Councilor Jacqueline Zahn regarding the appointment of a council liaison to the negotiating team for collective bargaining with the Burrillville Teachers’ Association.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

06-287  VOTED to refer to the Screening Subcommittee the application from David L. Marcotte for reappointment to the Recreation Commission.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

9.     Town Clerk/Communication:  

06-288  VOTED to receive and file the correspondence from Russell J. Chateauneuf, P.E., Chief, Groundwater and Wetlands Protection, DEM Office of Water Resources regarding Freshwater Wetlands application 05-0567 in reference to George Eddy Drive, Utility Pole No. 51, Assessor’s Plat 245, Lot 35.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Nancy F. Binns.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

10.     Additional New Business:  

06-289  Request for Executive Session from Council Vice President Jacqueline Zahn and Michael C. Wood, Town Manager, pursuant to Rhode Island Open Meeting Law [42-46-5 (a)(2)] for discussions relating to litigation matters;  [42-46-5 (a)(2)] relative to collective bargaining regarding the Council 94 collective bargaining agreement and regarding negotiations with the Burrillville Teachers’ Association; [42-46-5 (a)(4)] for review, discussion and action related to investigative proceedings regarding allegations of civil or criminal misconduct and [42-46-5(a)(5)] for review, discussion and action related to the acquisition, sale and exchange of real property.

Note:  Councilor Jacqueline Zahn withdrew her request for executive session pursuant to [42-46-5 (a)(2)] relative to collective bargaining regarding negotiations with the Burrillville Teachers’ Association.

Note:  There was a brief recess before the executive session.

The Town Council returned to open session at 9:32 p.m.

VOTED to seal the minutes of executive session, noting that one vote had been taken.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. 06-290  VOTED to table to the next meeting the discussion, consideration and action on a collective bargaining agreement between the Town of Burrillville and Council 94, Local 186.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Edward F. Bonczek, Margaret L. Dudley and Ronald E. Faford.

12.      VOTED to adjourn at 9:33 p.m.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F.
