MEETING of the Town Council held Wednesday, December 13, 2006 at 7:00 o'clock p.m. in the Media Center, Burrillville High School, 425 East Avenue, Harrisville, for and within the Town of Burrillville.

PRESENT:  Nancy F. Binns, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Wallace F. Lees, Norman C. Mainville and Cynthia L. Roe

MEMBERS ABSENT:  None

The Town Clerk called the meeting to order at 7:00 p.m.

1.      Organization of the Burrillville Town Council:

A.      That in accordance with Article III, Section 3.01 and Section 3.02 entitled Town Council of the Town Charter, the Town Council shall meet this day for the purpose of entering upon their respective duties and for the appointment and approval of such Town Offices as are by law made elective by the Town Council; and that the oath of office shall be administered to all newly elected town officials.

The Town Clerk called newly elected officials forward and asked Walter J. Kane, Town Solicitor to administer the oath of office.  Councilors Kevin M. Blais, John M. Karmozyn Jr., Wallace F. Lees, Norman C. Mainville and Cynthia L. Roe swore the oath of office. Walter J. Kane congratulated the newly elected Councilors, speaking briefly of the proactive role of the Town Council.

B.      The clerk entertained nominations for President of the Town Council.  Councilor Nancy F. Binns was nominated by Councilors Margaret L. Dudley and Wallace F. Lees.  Councilor Wallace F. Lees was nominated by Councilor Norman C. Mainville.  Councilor Lees declined the nomination.

VOTED that in accordance with Article III, Section 3.08 of the Town Charter, Councilor Nancy F. Binns be and hereby is appointed President of the Town Council on a unanimous vote.  Voting in favor of the motion were Councilors Nancy F. Binns, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Wallace F. Lees, Norman C. Mainville and Cynthia L. Roe.  

C.      The clerk entertained nominations for Vice President of the Town Council.  Councilor Wallace F. Lees was nominated by Councilors Margaret L. Dudley and Norman C. Mainville.  Councilor Kevin M. Blais was nominated by Councilor Cynthia L. Roe.

VOTED that nominations be closed.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Margaret L. Dudley.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Wallace F. Lees, Norman C. Mainville and Cynthia L. Roe.

VOTED that in accordance with Article III, Section 3.08 of the Town Charter, Councilor Wallace F. Lees be and hereby is appointed Vice President of the Town Council on a vote of five in favor, two opposed.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees Margaret L. Dudley, John M. Karmozyn Jr., and Norman C. Mainville.  Councilors Kevin M. Blais and Cynthia L. Roe voted in opposition.
Council President Nancy F. Binns and Council Vice President Wallace F. Lees assumed the seats designated for Council President and Vice President.  Council President Nancy F. Binns announced a brief recess to allow the Councilors to assume seats of their choosing.

D.      VOTED to open discussion of appointment of a Town Solicitor.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Margaret L. Dudley.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.  

Discussion:  Councilor Norman C. Mainville read a letter from the solicitor into the record:

Dear Council Members:
I have had the pleasure of serving as Town Solicitor for the past sixteen (16) years.  It has been an enjoyable experience working with the members of the Council and the other officials of the Town.
In my opinion no community in this area of the state has made greater efforts to meet current challenges, prepare for the future of the town and yet maintain a sound financial base. You and your predecessors are to be commended for the policy direction you have set for the Town.  The manager, department heads, and town employees have done an outstanding job in implementing your direction.  I am proud to have played a role with all of you to make Burrillville a community of which we can be all proud.
        However, at this stage in my career I can no longer continue to assume the responsibility of the position of Town Solicitor.  If the Council sees fit, I would accept a position of an Assistant Solicitor.  This will allow me to assist the town on projects in which I [have] been involved.  I might even sit with the Council from time to time.
        Again, please accept my sincere thanks for the opportunity to be a member of a group of persons dedicated to serving the Town.

Councilor Mainville read a letter from Timothy F. Kane into the record.

Dear Honorable Council Members and Council Members-Elect:
        Please consider this letter as an expression of my interest in being appointed Solicitor for the Town of Burrillville.  As you know, I have served as an Assistant Solicitor for the Town for the past eight years, which has afforded me the opportunity to become familiar with all aspects of municipal law.
        If appointed, I intend to ask the Town Council’s approval of my designation of the following attorneys as Assistant Solicitors:  William L. Bernstein, Nichole Carroll-Barnes, Patrick J. Dougherty and Walter J. Kane.  I also request your approval of the designation of Jeffrey W. Kasle as Special Counsel for Labor Relations.  Subject to the Town Council’s approval, I intend to designate the attorney selected by the School Committee as an Assistant Solicitor.
        It has been a pleasure to serve as Assistant Town [Solicitor] and I ask for your full consideration to be appointed as Town Solicitor.

MOTION to generate a resolution to seek a new solicitor and to accept applications for the positions of solicitor and assistant solicitors.

Motion by Councilor Kevin M. Blais.  Seconded by Councilor Cynthia L. Roe.  The motion failed, two in favor, five opposed.  Voting in favor of the motion were Councilors Kevin M. Blais and Cynthia L. Roe.  Council President Nancy F. Binns and Councilors Wallace F. Lees, Margaret L. Dudley, John M. Karmozyn Jr. and Norman C. Mainville voted in opposition.

VOTED that Timothy F. Kane shall be appointed Town Solicitor to serve at the pleasure of the Town Council.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Margaret L. Dudley.  The motion carried, five in favor, two opposed.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Margaret L. Dudley, John M. Karmozyn Jr. and Norman C. Mainville.  Councilors Kevin M. Blais and Cynthia L. Roe voted in opposition.

E.      That in accordance with Article VII, Section 7.01 of the Town Charter, Assistant Town Solicitors shall be designated; and that the attorney selected by the School Committee shall be appointed Assistant Town Solicitor, at the request of the Town Solicitor; and that Jeffrey W. Kasle shall be designated as Special Counsel for Labor Relations.  

VOTED the appointment of William Bernstein, Nicole Carroll-Barnes, Patrick Dougherty and Walter J. Kane as assistant town solicitors; and Jeffrey W. Kasle as the Labor Relations Counsel.

Discussion:  Councilor Norman C. Mainville requested that the Council be provided with a list of legal expenses by attorney and a list of pending litigation.

Motion by Councilor Margaret L. Dudley.  Seconded by Councilor Wallace F. Lees.  The motion carried unanimously.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.  

F.      VOTED that in accordance with Article VI, Section 6.02 of the Town Charter, Pierre G. Rondeau shall be reappointed Judge of Probate for the ensuing two years, term of office to be concurrent with that of the Town Council.

Motion by Councilor Wallace F. Lees.  Seconded by Councilor Margaret L. Dudley.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.  

G.      That in accordance with Chapter XV, Section 15-7(f) of the General Ordinances of the Town of Burrillville, a Judge for the Municipal Court shall be appointed.  The term of appointment shall be for two (2) years, terminating on December 31, 2008.  

·       Kevin Heitke, Attorney, was nominated by Councilors Kevin M. Blais and Cynthia L. Roe.
·       Judge Joseph Carroll was nominated by Councilors Wallace F. Lees and Margaret L. Dudley.
·       Richard E. Kyte, Jr. was nominated by Councilor Norman C. Mainville.

Discussion:  Councilor Kevin M. Blais produced a letter of interest from Kevin Heitke, which the clerk was instructed to read into the record:

Greetings:
Please be advised that I am interested in having my name considered for the position of Municipal Court Judge at your organizational meeting presently scheduled for this evening.  In support of my consideration, please find attached my resume.  I have been a resident of the Town of Burrillville for 16 years and have been running my private practice law firm in our town since March 1, 1996.  I presently hold no positions, elected or appointed, with the Town of Burrillville or any other Town in the State of Rhode Island.

The nomination of Kevin Heitke failed, three in favor, four opposed.  Voting in support were Councilors Kevin M. Blais, Margaret L. Dudley and Cynthia L. Roe.  Council President Nancy F. Binns and Councilors Wallace F. Lees, John M. Karmozyn Jr., and Norman C. Mainville voted in opposition.

The nomination of Joseph P. Carroll passed, four in favor, three opposed.  Voting in support were Council President Nancy F. Binns and Councilors Wallace F. Lees, Margaret L. Dudley and John M. Karmozyn, Jr.  Councilors Kevin M. Blais, Norman C. Mainville and Cynthia L. Roe voted in opposition.

The nomination of Richard E. Kyte Jr. passed, four in favor, three opposed.  Voting in support were Councilors Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn, Jr. and Norman C. Mainville.  Council President Nancy F. Binns and Councilors Wallace F. Lees and Cynthia L. Roe voted in opposition.

On advice of the Solicitor, a vote was conducted to break the tie.

The nomination of Joseph P. Carroll passed, four in favor, three opposed.  Voting in support were Council President Nancy F. Binns and Councilors Wallace F. Lees, Margaret L. Dudley and John M. Karmozyn, Jr.  Councilors Kevin M. Blais, Norman C. Mainville and Cynthia L. Roe voted in opposition.

Having garnered the majority vote of the Town Council, Joseph P. Carroll was declared Municipal Court Judge.

H.      That in accordance with Chapter XV, Section 15-7(f) of the General Ordinances of the Town of Burrillville, an Associate Judge shall be appointed for the Municipal Court.  The term of appointment shall be for two (2) years, terminating on December 31, 2008.  

Councilor Norman C. Mainville read the correspondence from Richard E. Kyte, Jr., into the record:

Please accept this letter as application for reappointment as Municipal Court Judge for the Town of Burrillville.
I appreciate the consideration that is given to the application and the privilege in serving in such capacity on behalf of the Town.

I.      That by virtue of her office as President of the Town Council of the Town of Burrillville Councilor Nancy F. Binns be and she hereby is a member of the Board of Administration.
                
J.      That in accordance with a Trustee Deed recorded by the late Austin T. Levy and recorded in Deed Book 43, Page 372 to 382 inclusive, of the Records of Deeds in the Town of Burrillville, Council President Nancy F. Binns be and she hereby is appointed Chairman of the Board of Administration.

K.      That the appointment to the Town Council Ordinance Subcommittee of three (3) members and one (1) alternate member be now taken up.

·       Councilor Margaret L. Dudley was nominated by Councilors Norman C. Mainville and Wallace F. Lees.

Blais, Margaret L. Dudley, Norman C. Mainville and Cynthia L. Roe.  Councilor John M. Karmozyn voted in opposition.

The nomination of Councilor Margaret L. Dudley passed unanimously.  Voting in support of the nomination were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

The nomination of Councilor Nancy F. Binns passed, six in favor, one opposed.  Voting in support of the nomination were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr. and Cynthia L. Roe. Councilor Norman C. Mainville voted in opposition.
The nomination of Councilor Kevin M. Blais passed, five in favor, two opposed.  Voting in support of the nomination were Councilors Wallace F. Lees, Kevin M. Blais, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe. Council President Nancy F. Binns and Councilor Margaret L. Dudley voted in opposition.

Council President Nancy F. Binns announced that the Ordinance Subcommittee would consist of Council President Nancy F. Binns, Councilors Margaret L. Dudley and Cynthia L. Roe, with Councilor Kevin M. Blais serving as an alternate member.

L.      That the appointment to the Town Council Screening Subcommittee of three (3) members and one (1) alternate member be now taken up.  

·       Councilor Wallace F. Lees was nominated by Councilor Norman C. Mainville.
·       Councilor Norman C. Mainville placed his name into nomination.
·       Councilor John M. Karmozyn, Jr. placed his name into nomination.
·       Councilor Kevin M. Blais placed his name into nomination.

The nomination of Councilor Wallace F. Lees passed unanimously.  Voting in support of the nomination were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

The nomination of Councilor Norman C. Mainville passed unanimously.  Voting in support of the nomination were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

The nomination of Councilor John M. Karmozyn, Jr. passed unanimously.  Voting in support of the nomination were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

Council President Nancy F. Binns announced that the Screening Subcommittee would consist of Councilors Wallace F. Lees, John M. Karmozyn, Jr. and Norman C. Mainville, with Councilor Kevin M. Blais serving as an alternate member.

M.      VOTED that Councilors Margaret L. Dudley and Norman C. Mainville are hereby appointed to the Administrative Audit Committee.  

Motion by Councilor John M. Karmozyn, Jr.  Seconded by Councilor Cynthia L. Roe.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

N.      VOTED that Councilor Cynthia L. Roe is hereby appointed liaison between the Town Council and the Burrillville Organization for Substance Abuse Prevention (BOSAP).

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Wallace F. Lees.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

O.      VOTED that Cynthia L. Roe is hereby appointed liaison between the Town Council and the Downtown Pascoag Neighborhood Association (DPNA).

Motion by Councilor Wallace F. Lees.  Seconded by Councilor Margaret L. Dudley.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

P.      VOTED that Councilor Wallace F. Lees is hereby appointed liaison between the Town Council and the Burrillville Extended Care.  

Motion by Councilor Margaret L. Dudley.  Seconded by Councilor Norman C. Mainville.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

Q.      VOTED that Councilor Margaret L. Dudley is hereby appointed liaison between the Town Council and the Burrillville Housing Authority.  

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Wallace F. Lees.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

R.      VOTED that John M. Karmozyn, Jr. is hereby appointed liaison between the Town Council and the Burrillville Industrial Foundation.  

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Margaret L. Dudley.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

S.      VOTED that Councilor Wallace F. Lees is hereby appointed liaison between the Town Council and the Jesse M. Smith Memorial Library.  

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Cynthia L. Roe.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

T.      VOTED that Councilor Norman C. Mainville is hereby appointed liaison between the Town Council and the Planning Board.

Motion by Councilor Kevin M. Blais.  Seconded by Councilor Cynthia L. Roe.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

U.      VOTED that Councilor John M. Karmozyn, Jr. is hereby appointed liaison between the Town Council and the Burrillville Recreation Commission.  

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Margaret L. Dudley.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

V.      That the appointment of a liaison between the Town Council and the School Committee be now taken up.

·       Council President Nancy F. Binns was nominated by Councilors Wallace F. Lees and Norman C. Mainville.
·       Councilor Cynthia L. Roe was nominated by Councilor Kevin M. Blais.

VOTED to appoint Council President Nancy F. Binns as liaison to the School Committee, with Councilor Cynthia L. Roe serving as an alternate; and that the clerk be instructed to notify the School Committee of the decision.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Wallace F. Lees.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

W.      VOTED that Councilor Wallace F. Lees is hereby appointed liaison between the Town Council and the Burrillville Senior Citizens.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Cynthia L. Roe.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

X.      VOTED that Councilor Wallace F. Lees is hereby appointed liaison between the Town Council and the Sewer Commission.  

Motion by Councilor Kevin M. Blais.  Seconded by Councilor Norman C. Mainville.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

Y.      VOTED that Councilor Kevin M. Blais is hereby appointed liaison between the Town Council and the Zoning Board of Review.

Motion by Councilor Margaret L. Dudley.  Seconded by Councilor John M. Karmozyn, Jr.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

Z.      VOTED that Council President Nancy F. Binns is hereby appointed liaison between the Town Council and the W.L. Callahan Building Committee.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor John M. Karmozyn, Jr..  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

AA.     That the appointment of a liaison between the Town Council and the Library Building Committee be now taken up.
        
MOTION that Councilors Kevin M. Blais and John M. Karmozyn, Jr. be joint liaisons.

Motion by Councilor Kevin M. Blais.  Seconded by Councilor Cynthia L. Roe.

Councilor Margaret L. Dudley was nominated by Councilor Wallace F. Lees.

Based upon Councilor Karmozyn’s deferral in honor of Councilor Dudley’s request to be appointed to this committee declination, the motion was withdrawn by Councilor Kevin M. Blais.  The second was withdrawn by Councilor Cynthia L. Roe.

MOTION that Councilors Kevin M. Blais and Margaret L. Dudley be appointed as joint liaisons to the Library Building Committee.

Motion by Councilor Kevin M. Blais.  Seconded by Norman C. Mainville.  The motion failed, two in favor, five opposed.  Voting in favor of the motions were Councilors Kevin M. Blais and Cynthia L. Roe.  Council President Nancy F. Binns and Councilors Wallace F. Lees, Margaret L. Dudley, John M. Karmozyn Jr, and Norman C. Mainville voted in opposition.

·       Councilor Kevin M. Blais was nominated by Councilor Cynthia L. Roe.

The nomination of Councilor Kevin M. Blais failed, two in favor, five opposed.  Voting in favor of the nomination were Councilors Kevin M. Blais and Cynthia L. Roe.  Council President Nancy F. Binns and Councilors Wallace F. Lees, Margaret L. Dudley, John M. Karmozyn Jr., and Norman C. Mainville voted in opposition.

VOTED that Councilor Margaret L. Dudley is hereby appointed as liaison to the Library Building Committee.

A.      VOTED to grant the petition of Verizon New England Inc. and The Narragansett Electric Company for permission to locate and maintain poles, wires and fixtures, including the necessary sustaining and protecting fixtures along and across the following public ways:  Pulaski Road – to relocate three joint pole locations as shown on the attached plan (necessity – the relocations are required for road improvements) at their own expense.

Motion by Councilor Wallace F. Lees.  Seconded by Councilor Norman C. Mainville.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

B.      VOTED to grant the petition of Verizon New England Inc. and The Narragansett Electric Company for permission to locate and maintain poles, wires and fixtures, including the necessary sustaining and protecting fixtures along and across the following public ways:  Power Lane – to relocate two joint pole locations as shown on attached plan (necessity – the relocations are required for road improvements).

06-316  VOTED to open the correspondence from Scott P. Rabideau, Chair, Burrillville Sewer Commission, regarding the Commission’s request that the Town Council consider and act on a temporary waiver of the drainage ordinance for certain residences.

Motion by Councilor Wallace F. Lees.  Seconded by Councilor Margaret L. Dudley.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

VOTED to allow a temporary waiver of the drainage ordinance for three (3) streets in Glendale.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Margaret L. Dudley.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

VOTED to reconsider item #06-315 on the petition from Verizon New England.

Motion by Councilor Margaret L. Dudley.  Seconded by Councilor Norman C. Mainville.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

VOTED to withdraw the original motion and amend to grant permission to Verizon to relocate poles.

Motion by Councilor Wallace F. Lees.  Seconded by Councilor Norman C. Mainville.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F.
