HEARING of the Town Council held Wednesday, October 3, 2007 at 7:10 P.M. in the Media Center, Burrillville High School, 425 East Avenue, Harrisville, for and within the Town of Burrillville.

PRESENT:  Council President Nancy F. Binns, Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe

MEMBERS ABSENT:  None

The Town Council of the Town of Burrillville, Rhode Island, acting in their capacity as judge of qualification of members of the School Committee, as provided in §11.07 of the Burrillville Town Charter, will hear evidence to consider and adjudicate alleged violations of the Burrillville Town Charter by School Committee Member Raymond Trinque, specifically Article XI §11.03 which states "a member of the School Committee shall hold no other employment in the service of the Town of Burrillville".

VOTED to close the hearing.

Motion by Councilor Wallace F. Lees.  Seconded by Councilor John M. Karmozyn, Jr.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

VOTED to reopen the hearing.

Motion by Councilor Cynthia L. Roe.  Seconded by Councilor Wallace F. Lees.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

VOTED to close the hearing.

Motion by Councilor Kevin M. Blais.  Seconded by Councilor Margaret L. Dudley.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

5.      Deliberation/Decision

MOTION that, based on all the evidence introduced at the public meeting including but not limited to the stipulated facts and the testimony of Raymond Trinque, that the Town Council finds Mr. Trinque in violation of §11.03 of the Burrillville Town Charter which states, in part, that "a member of the School Committee shall hold no other employment in the service of the Town of Burrillville", and accordingly that Mr. Trinque's office as School Committee member shall be forfeited immediately, pursuant to §11.04 of the Town Charter.
Motion by Councilor Margaret L. Dudley.  Seconded by Councilor John M. Karmozyn.  The motion failed, three in favor, three opposed, one abstention.  Voting in favor of the motion were Councilors Margaret L. Dudley, John M. Karmozyn Jr., and Cynthia L. Roe.  Voting in opposition were Council President Nancy F. Binns and Councilors Wallace F. Lees and Norman C. Mainville.   Councilor Kevin M. Blais abstained.

VOTED to adjourn.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Wallace F. Lees.  The vote was unanimous.  Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.
