PUBLIC HEARING of the Town Council held Wednesday, November 14, 2007 at 7:21 P.M. in the Council Chamber, Town Building, Harrisville for and within the Town of Burrillville.
PRESENT: Council President Nancy F. Binns, Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe

Relative to considering and acting on the following proposed changes to the Revised General Ordinances of the Town of Burrillville:
The Town Council of the Town of Burrillville hereby ordains as follows:
The General Ordinances of the Town of Burrillville are hereby amended, as follows:
Chapter 16, OFFENSES AND MISCELLANEOUS PROVISIONS, §16-3 entitled Parks and Recreation areas, use regulations and §16-4 entitled Swimming, bathing, etc., are hereby revoked in their entirety.
Chapter 16.5, PARKS AND RECREATION, is amended by adding Sec 16.5-1. Parks and Recreation areas; use regulations.
NOTE: The notice of hearing was advertised in the legal section of the Woonsocket Call on Wednesday, November 7, 2007.
1. Comments/Input/Recommendation from the Ordinance Subcommittee
Councilor Margaret L. Dudley, Chair, Ordinance Subcommittee noted that the request for these amendments had been received from the Burrillville Recreation Commission. Councilor Dudley said that a fee schedule had been included in the original proposal but that the Ordinance Subcommittee recommended that the Town Council adopt a fee schedule separately. Councilor Dudley reported that the intention of the amendments was to specify hours of operation for the various parks. Councilor Dudley indicated that the Ordinance Subcommittee recommended adoption.
2. Comments/Input/Recommendations by the Administration (Town Solicitor, Town Manager, Administrative Staff)
Michael C. Wood, Town Manager, reviewed the proposal.
3. Proponents:
Kurt Schatz, Chair, Burrillville Recreation Commission, said that the intent of the proposal was to provide the Police Department with the ability to enforce the restrictions set forth in the proposal.
4. Opponents: None
5. VOTED to close the public hearing.
Motion by Councilor Norman C. Mainville. Seconded by Councilor Margaret L. Dudley. The vote was unanimous. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.
6. Town Council Members Comments/Input/Deliberation
Councilor Kevin M. Blais raised a concern that the restricted hours would prohibit fishing during hours when fishing usually takes place. Councilor Blais recommended that the proposal be amended to restrict the park hours to: from one hour before sunrise until one after sunset, unless otherwise noted at that facility.
Timothy F. Kane, Town Solicitor, suggested that the phrase unless otherwise noted at the facility would not be legally appropriate and that the ordinance should specify the hours.
The matter was discussed.
VOTED to continue until a time certain of the regular meeting of January 9, 2008.
Motion by Councilor Kevin M. Blais. Seconded by Councilor John M. Karmozyn, Jr. The vote was unanimous. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.
