4-23-2008 - Public Hearing - License Transfer
PUBLIC HEARING of the Town Council held Wednesday, April 23, 2008 at 7:17 P.M. in the Council Chamber, Town Building, Harrisville for and within the Town of Burrillville.

MEMBERS PRESENT:  Council President Nancy F. Binns, Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., and Norman C. Mainville

MEMBERS ABSENT:  Councilor Cynthia L. Roe was excused due to family illness.

Application for transfer of Retail License Class B (Victualer) to sell beverages under Title 3, Chapter 5 of the General Laws of Rhode Island 1956, and amendments thereto, has been made as follows.

FROM: Elite Pizza, LLC d/b/a Elite Pizza Restaurant, in building owned by Valliere Realty Associates, LLC, for premises located at 68 North Main Street, Pascoag (Assessor's Map 158, Lot No. 72).

TO: Sweet Tomato Pizza and Grill, LLC  d/b/a Sweet Tomato Pizza and Grill, in building owned by Valliere Realty Associates, LLC, for premises located at 68 North Main Street, Pascoag (Assessor's Map 158, Lot No. 72).

NOTE:  Notice of the Public Hearing was duly advertised in the Legal Section of the Woonsocket Call on Wednesday, April 9, 2008 and Wednesday, April 16, 2008. Notice was sent to all abutting property owners by certified mail, as required by law.

A)      Report/recommendation of the Building Official was on file. The Building Official reported no problems with the establishment.

B)      Report/recommendation of the Chief of Police was on file. Lt. Kevin S. SanAntonio, Acting Chief of Police, indicated that the Police Department had no objections.

C)      Report/recommendation of the Fire Chief was on file.

D)      Report/recommendation of the Department of Health was on file.

E)      Council President Nancy F. Binns noted that an objection had been filed by the Rhode Island Liquor Distributors Association.  Timothy F. Kane, Town Solicitor, suggested that if the Council favorably considered the application, issuance should be subject to Rhode Island Liquor Distributors Association withdrawing their objection.

F)      Report/recommendation of the Tax Collector was on file.

G)      Certificate of Insurance in compliance with §8-28 of the Ordinances of the Town of Burrillville was on file.

H)      Certificate of Good Standing from the State Division of Taxation was pending.  

The hearing of all interested parties in regard to the granting of this license. Note:  Persons who wish to address the Town Council shall state their name and address.

3.      VOTED to close the public hearing.

Motion by Councilor Norman C. Mainville. Seconded by Councilor John M. Karmozyn, Jr. The vote was unanimous by the six members present. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., and Norman C. Mainville. Councilor Cynthia L. Roe was excused.

4.      Town Council Members Comments/Input/Deliberation:  None

5.      VOTED to grant transfer of Retail License Class B (Victualer) to sell beverages under Title 3, Chapter 5 of the General Laws of Rhode Island 1956, and amendments thereto, FROM: Elite Pizza, LLC d/b/a Elite Pizza Restaurant, in building owned by Valliere Realty Associates, LLC, for premises located at 68 North Main Street, Pascoag (Assessor's Map 158, Lot No. 72); TO: Sweet Tomato Pizza and Grill, LLC  d/b/a Sweet Tomato Pizza and Grill, in building owned by Valliere Realty Associates, LLC, for premises located at 68 North Main Street, Pascoag (Assessor's Map 158, Lot No. 72); with the caveat that the conditions and requirements be met prior to the transfer.

Motion by Councilor Kevin M. Blais. Seconded by Councilor John M. Karmozyn, Jr. The vote was unanimous by the six members present. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., and Norman C. Mainville. Councilor Cynthia L. Roe was excused.

6.      Victualing License:

VOTED to grant a new victualing license from Sweet Tomato Pizza and Grill, LLC  d/b/a Sweet Tomato Pizza and Grill, in building owned by Valliere Realty Associates, LLC, for premises located at 68 North Main Street, Pascoag (Assessor's Map 158, Lot No. 72), subject to receipt of all certificates and payment of all fees and debts.

Motion by Councilor Norman C. Mainville. Seconded by Councilor Margaret L. Dudley. The vote was unanimous by the six members present. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., and Norman C. Mainville. Councilor Cynthia L. Roe was excused.

7.      VOTED to adjourn at 7:22 P.M.

Motion by Councilor Norman C. Mainville. Seconded by Councilor John M. Karmozyn, Jr. The vote was unanimous by the six members present. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., and Norman C. Mainville. Councilor Cynthia L. Roe was excused.
