PUBLIC HEARING of the Town Council held Wednesday, June 25, 2008 at 7:02 P.M. in the Council Chamber, Town Building, Harrisville for and within the Town of Burrillville.
PRESENT: Council President Nancy F. Binns, Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley and Norman C. Mainville.
MEMBERS ABSENT: Councilors John M. Karmozyn Jr. and Cynthia L. Roe were excused as they were out of town.
Application to sell beverages on a deck or patio in accordance with Section 8-55 (b) of the ordinances of the Town of Burrillville, and amendments thereto, for GCAL, Inc. d/b/a Bella Restaurant, in building owned by Giobella Realty, LLC, for premises located at 1992 Victory Highway, (Assessor's Map 130, Lot No. 4).
NOTE: Notice of the Public Hearing was duly advertised in the Legal Section of the Woonsocket Call on Wednesday, June 18, 2008.
Notice was sent to all abutting property owners by certified mail, as required by law.
A) Report/recommendation of the Building Official
Joseph Raymond, Building Official, reported on the planned changes and his review of the site. Mr. Raymond reported that the building on the property is more than 200 feet from any residential use.
B) Report/recommendation of the Tax Collector.
It was noted that taxes were current at the time of the hearing.
The hearing of all interested parties in regard to the granting of this license. Note: Persons who wish to address the Town Council shall state their name and address.

Al Lavigne spoke on behalf of himself and his cousins Alice and Leah Lavigne, who are co-owners of property that abuts Bella Restaurant. Mr. Lavigne said that the three of them had no reservations or objections to the request. Mr. Lavigne said that the restaurant is an excellent neighbor and an asset to the community.

3. VOTED to close the public hearing.
Motion by Councilor Norman C. Mainville. Seconded by Councilor Margaret L. Dudley. The vote was unanimous by the five members present. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley and Norman C. Mainville. Councilors John M. Karmozyn Jr. and Cynthia L. Roe were excused.
4. VOTED to grant permission to GCAL, Inc. d/b/a Bella Restaurant to serve alcoholic beverages on a deck or patio.
Motion by Councilor Norman C. Mainville. Seconded by Councilor Wallace F. Lees.
Councilor Kevin M. Blais questioned whether the ordinance required that applications for permission to serve alcohol on decks and patios could be made only at the time of license renewal. It was pointed out that the ordinance provides for application at any time that the applicant holds a validly issued liquor license. Councilor Blais questioned whether an open patio would qualify under the ordinance. GCAL's proposal was discussed.
Giovan Calapai, President of GCAL, Inc. discussed the intention to maintain a family restaurant atmosphere. He confirmed that alcohol would be served by staff.
MOTION AS AMENDED to approve, subject to submission of a radius map prepared by a licensed surveyor showing that there are no residents within 200 feet of the premises.
Amendment by Councilor Norman C. Mainville. Seconded by Councilor Wallace F. Lees.
The vote on the motion, as amended, was unanimous by the five members present. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley and Norman C. Mainville. Councilors John M. Karmozyn Jr. and Cynthia L. Roe were excused.
5. VOTED to adjourn at 7:12 P.M.
