Regular Meeting 01-24-2001
REGULAR MEETING of the Town Council held Wednesday, January 24, 2001 at 8:10 o'clock p.m. in the Council Chamber, Town Building, Harrisville, for and within the Town of Burrillville.

MEMBERS PRESENT:  Council President Wallace F. Lees; Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

MEMBERS ABSENT:  None


        1.      Council President Wallace F. Lees opened the meeting by leading those present in pledging allegiance to the flag.

        2.      VOTED to accept the minutes of the Regular Meeting of the Town Council held Wednesday, January 10, 2001 and the Workshop of January 10, 2001, and dispense with the reading of said minutes.

Councilor Norman C. Mainville made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.


        3.      Public Comment: Linda Shinskey of Wallum Lake Rd addressed the Town Council with her concerns about the conduct of Police Officers. The administration stated that the matter to which she referred had been investigated and resolved.

        4.      General Good and Welfare.  

Councilman Norman C. Mainville congratulated and commended Councilman Louis Bleiweis on his election to the Burrillville Athletic Hall of Fame.

Councilman Norman C. Mainville mentioned that Chinese New Year and Australia Day are being celebrated this week.

Town Manager Michael C. Wood reminded those present that a workshop on the Stillwater Mill project is scheduled for January 25, 2001 at 6:30 p.m. at the A.T. Levy School auditorium.  All who are available were encouraged to attend.

        6.      Special Business:  

01-11   VOTED to grant a victualing license and a Class F liquor license to the Society of St. Vincent De Paul at the Our Lady of Good Help Church to apply at 1063 Victory Highway, Mapleville on March 11, 2001 (Rain Date March 18, 2001).

Councilor William E. Gonyea made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

        7.      Old Business:  None
        8.      New Business:

01-12   VOTED to receive and open the memo from John P. Mainville, Finance Director, regarding The Budget Calendar for FYE 6/30/2002.

Councilor William E. Gonyea made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

VOTED to approve.

Councilor Norman C. Mainville made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

01-13   VOTED that in accordance with RIGL Chapter 2-14 Tree Wardens, Richard St. Sauveur shall be appointed Tree Warden.

Councilor Norman C. Mainville made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

01-14   VOTED to deny abatement of interest requested by Pauline Piotrowski of West Melbourne, FL.

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

01-15   VOTED to appoint Kenneth Johnson as an auxiliary member of the Zoning Board of Review.

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

        9.      Town Clerk/Communication:  

01-16   VOTED to receive and file the correspondence from Russell Chateauneuf, Chief, Permitting Section, D.E.M. Office of Water Resources, regarding a permit for an Insignificant Alteration for Patricia Robitaille, Application #00-0395 in reference to the property and proposed project located: approximately 65 feet south of West Road, utility pole number 3, approximately 550 feet east of the intersection of West Road and Hill Road, Assessors Plat 72, Lot 15.

Councilor Jacqueline Zahn made the motion.  Councilor William A. Andrews seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

01-17   VOTED to receive and file the correspondence from Russell Chateauneuf, Chief, Permitting Section, D.E.M. Office of Water Resources, regarding a permit for an Insignificant Alteration for Bertrand and Doris Beaulieu, Application #00-0431 for property approximately 200' southeast of Route 102 (Bronco Highway), approximately 2200' northeast of its intersection with Route 107 (East Avenue), by Utility Pole No. 173, Assessor's Plat 146, portion of Lot 5.

Councilor Jacqueline Zahn made the motion.  Councilor Norman C. Mainville seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

01-18   VOTED to receive and file the correspondence from Russell Chateauneuf, Chief, Permitting Section, D.E.M. Office of Water Resources, regarding a permit for an Insignificant Alteration for Uniplast Films, Application #00-0310 for property approximately 150' west of Douglas Pike (Route 7), and immediately north of Bronco Highway (Route 102), near Utility Pole No. 231-S, Map 114, Lot 16.

Councilor William E. Gonyea made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

        10.     VOTED to receive the following reports:

        1.      Report of the Town Treasurer for the period beginning June 30, 2000 through December 31, 2000;
        2.      Report of the Town Treasurer for the period beginning July 1, 1999 and ending June 30, 2000 in regards to Treatment & Administrative Expenses of the Wastewater Treatment Facilities - no report; Statement of Expenses for December, 2000;
        3.      a.  Copy of the Report of the Tax Collector for the month of December, 2000;
               b.  Copy of the report submitted to Town Treasurer by the Tax Collector for Tax Certificates issued during the month of December, 2000;
        4.      Copy of the report submitted to Tax Collector, John P. Mainville for the Burrillville Sewer Commission for the month of December, 2000;
        5.      Report of the Director of the Department of Public Works for the months of - no report;
        6.      Report of the Chief of Police - report for November and December;
        7.      Report of the Office of Building Official - no report for November and December;
        8.      Report of the Animal Control Officer for December 2, 2000 to December 31, 2000;

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

11.     Additional New Business to be considered and acted upon:

01-19   VOTED to grant the request for Executive Session from Town Manager Michael C. Wood pursuant to Rhode Island Open Meeting Law [42-46-5 (a)(2)] to collective bargaining regarding Police Union IBPO, Local 369 contract negotiations; and [42-46-5 (a) (4)] to discuss investigative proceedings of allegations of misconduct (civil or criminal) and to discuss the purchase of land for the possible construction of a new town library.

Councilor William E. Gonyea made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

The Council returned to Open Session. Councilwoman Jacqueline Zahn announced that two votes had been taken.

VOTED to seal the minutes of the executive session.

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

VOTED to adjourn at 10:56 p.m.

Councilor Jacqueline Zahn made the motion.  Councilor Edward F. Bonczek seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.
