REGULAR MEETING of the Town Council held Wednesday, February 28, 2001 at 7:00 o'clock p.m. in the Council Chamber, Town Building, Harrisville, for and within the Town of Burrillville.

MEMBERS PRESENT:  Council President Wallace F. Lees; Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

MEMBERS ABSENT:  None

        1.      Council President Wallace F. Lees led those present in pledging allegiance to the flag.

        2.      VOTED to accept the minutes of the Regular Meeting of the Town Council held Wednesday, February 14, 2001 and dispense with the reading of said minutes.

Councilor Louis Bleiweis made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

        3.      Public Comment:  None

        4.      General Good and Welfare of the Town of Burrillville.

Members of the Town Council and the audience joined Council President Wallace F. Lees in congratulating Councilor Louis Bleiweis on his 86th birthday.

Councilor Norman C. Mainville requested a letter be sent to Police Dispatcher Steven St. Pierre commending him for his actions.

        5.      Petitions:  

01-38   VOTED to refer to Town Solicitor Walter J. Kane the petition from Charles J. Vucci, Esq., of Gemma Law Associates, LLC, regarding personal injuries and damages sustained at the residence of David & Joann Negris, 1376 East Wallum Lake Road.

Councilor William E. Gonyea made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

01-39   VOTED to approve the application from the Rev. Roland L. Simoneau for a Victualing License to apply at the Church of Saint Teresa of the Child Jesus, Nasonville, subject to the approval of the Burrillville Police Department, Nasonville Fire Department and the Burrillville Building Official.

Councilor Louis Bleiweis made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.
01-40   VOTED to approve the application from Wayne G. Barber, d/b/a Waynes Place, for a Sunday & Holiday Business License to apply at 70 Pascoag Main St. (Assessors Map 175, Lot 44), subject to the approval of the Burrillville Police Department, Pascoag Fire Department and the Burrillville Building Official.

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. 01-41   VOTED to grant the application from Thomas F. Lapierre, d/b/a Financial Adjustment and Recovery, Inc., 12 Sayles Avenue, Pascoag, for renewal of Private Detective License No. 11.

01-42   VOTED to receive and open the correspondence from Colonel Bernard E. Gannon, Chief of Police, regarding use of matching funds for a 2000 Local Law Enforcement Block Grant.

Councilor William A. Andrews made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

VOTED to approve the request, to be taken from the contingency fund.

Councilor Louis Bleiweis made the motion.  Councilor William A. Andrews seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. 01-43   VOTED to receive and open the recommendation by the Ordinance Subcommittee regarding proposed Town Ordinance entitled Tax Exemption for Disabled Person.

Councilor Jacqueline Zahn made the motion.  Councilor William A. Andrews seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Discussion:  Councilor Jacqueline Zahn asked if the ordinance subcommittee had submitted a written recommendation.  As chair of the ordinance subcommittee, Councilor William A. Andrews reported that the subcommittee has reviewed agenda items 01-44, 01-45 and 01-46.  Councilors Norman C. Mainville and William A. Andrews stated that the subcommittee recommended that it be approved.  Councilor William A. Andrews stated for the public that the ordinance subcommittee consisted of Councilors Bonczek, Mainville and himself.  

Town Solicitor Walter J. Kane explained that, at the Town Councils request, he had prepared a draft ordinance, which he presented to the ordinance subcommittee.  The subcommittee recommended passage of the ordinance.  The ordinance was introduced as the next item on the agenda.  Mr. Kane stated that if the Council wanted to proceed, the only thing in order at the present meeting was to schedule a public hearing, at which time there could be an extensive discussion.

VOTED to receive and file.

Councilor Jacqueline Zahn made the motion.  Councilor Norman C. Mainville seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. 01-44   Introduction and first reading of proposed General Ordinances of the Town of Burrillville entitled Tax Exemption for Disabled Person, as requested by Councilor Edward F. Bonczek.

VOTED to set a date for the public hearing on March 14, 2001 at 7:00 p.m.

Councilor Jacqueline Zahn made the motion.  Councilor Louis Bleiweis seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

01-45   Recommendation by the Ordinance Subcommittee regarding proposed amendment to Town Ordinance entitled Soil Erosion and Sediment Control.

VOTED to receive and file.

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. 01-46   Introduction and first reading of proposed amendments to the General Ordinances of the Town of Burrillville entitled Soil Erosion and Sediment Control, as requested by Councilor Edward F. Bonczek.

VOTED to set a public hearing date of April 11, 2001.  

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Discussion:  William Flanagan spoke from the audience.  He stated that he had reviewed the Town Charter procedure for passing an ordinance, and asked whether the Council had established the ordinance subcommittee as a practice, to seek insight on proposed ordinances.  Members of the Council confirmed this practice. He asked whether the ordinance subcommittee used expert testimony or witnesses to come to a conclusion and make a recommendation.  Members of the subcommittee stated the Town Solicitor, Town Manager and Town Planner attended the subcommittee meeting to explain the reason for the ordinance and the proper wording.

01-47   Recommendation by the Ordinance Subcommittee regarding the proposed amendments to the Town Ordinance entitled Classification Plan  Town of Burrillville.

Discussion:  Councilor William E. Gonyea asked whether this would be a discussion of the proposed reorganization.  Council President Wallace F. Lees stated that it was his understanding that it would be a first reading, then setting a public hearing.  Councilor William E. Gonyea asked if the Town Council would vote at the time of the public hearing.  Town Solicitor Walter J. Kane stated that there could be a full discussion at that time.

MOTION to receive and file by Councilor William A. Andrews. Councilor Jacqueline Zahn seconded the motion.  

Note:  No vote was taken on the motion.

Discussion:  Councilor Norman C. Mainville stated that when this item came before the ordinance subcommittee, only two items were listed: the comptroller and administrative services director.  He stated that these items had no affect on the status of the current Finance Director, who is his brother.  He stated that an additional modification had been made, which does affect  the Finance Director.  He discussed whether it would be possible to separate the items so that he could vote on the comptroller and administrative services director.  He questioned whether he should recuse from all three.  There was a discussion of what the Ethics Board had advised.  

Councilor Jacqueline Zahn stated that agenda item 01-48 deals with the introduction, first reading and setting the hearing date of a public hearing.  Councilor William A. Andrews pointed out that the classification plan under discussion was the same as the ordinance subcommittee had reveiwed.  Town Manager Michael C. Wood stated that the proposal is the same as presented from the beginning, including the position of Finance Director, which is required by the Town Charter.  He pointed out the classification plan is a framework, from which a reorganization may occur.

Councilor Norman C. Mainville stated that, as he understoods it, the Council was discussing an ordinance that is general by nature and comes down to the budgetary process.  His interpretation was that he could vote; he could not participate in a specific item that would result in a monetary gain or loss to a relative.

William Flanagan stated that, according to Councilor William A. Andrews, the ordinance subcommittee has the priviledge of calling expert witnesses, and that they do so as needed.  Council President Wallace F. Lees pointed out that the previous item had been voted and that the next item should be opened before discussion continued. (Note:  The Clerk erroneously indicated a vote to receive and file item 01-47 had been made.)

01-48   Introduction and first reading of proposed amendments to the General Ordinances of the Town of Burrillville entitled Classification Plan  Town of Burrillville, as requested by Councilor Edward F. Bonczek.

MOTION by Councilman William A. Andrews to set a date for a public hearing on the classification plan on April 11, 2001.  Seconded by Councilor Jacqueline Zahn.  

Councilor Jacqueline Zahn pointed out Mr. Flanagans desire to speak and stated her concern that the public hearing on the classification plan should be held on a night other than a regular meeting night to ensure that people have an opportunity to fully discuss the issue.  Councilor William A.Andrews stated that if the public hearing was too long and there was not time to conclude the regular meeting, the regular meeting could be recessed to another date.

Councilor Louis Bleiweis stated that he was unconvinced about the necessity for this and would vote no on the public hearing.  Councilman Norman C. Mainville concurred.  He stated that the guidelines being set up raise the level to being too flat, that no other community has a flat, top heavy scenario.  He stated his concern about the expense.  

Councilor William A. Andrews discussed the various positions in the classification plan, including director of public works/engineer, comptroller and administrative services director.  He said he believed the classification plan to be a good idea  paying someone to save some money in the long run.  He stated that the ordinance subcommittee did vote to tell the Town Council that they favored the plan, although Councilor Mainville did recuse from that particular vote.

Councillor William E. Gonyea stated that a recent article in the Providence Journal regarding the plan opened a pandoras box and that he had received six phone calls from residents who oppose the plan.  He stated that he was prepared to support the plan; he could no longer do so.

Council President Wallace F. Lees stated that it was the duty of the Council at this meeting to set or not to set the date for the public hearing.  He stated that there were people in the audience who wanted to be heard, but they could not be heard under this item.  He said that a public hearing would give the people in the audience the opportunity to speak.

From the audience, William Flanagan asked about the subcommittee meeting and how they came to their conclusions, stating that this was germaine to the current item.  He pointed out that, historically, Burrillville residents have been able to come before the Town Council and ask reasonable questions and receive reasonable answers. He stated his concern over creating an additional layer of beauracracy that insulates the public from the decision-makers.  There was a discussion of the open meeting laws that limit discussion during a meeting of those items that are included on the agenda. It was noted by Town Solicitor Walter J. Kane that the item under consideration was whether to hold a public hearing.  Only discussion on that would be appropriate.  He pointed out that to discuss the merits of the plan at this meeting would exclude people who might have attended if it had been listed on the agenda.  Additional discussion would be appropriate at the public hearing if it were scheduled.  

William Flanagan asked whether the Finance Director, as the expert identified by the Town Charter, had been heard by the ordinance subcommittee on the issue of the reorganization. He suggested that, in his opinion, it would be premature to schedule a public hearing before the Finance Directors opinion had been heard.  William A. Andrews, chairman of the ordinance subcommittee, stated that the committee looked at the classifications and not the individuals involved.  
Council President Wallace F. Lees restated that, under the open meeting laws, this agenda item was not the appropriate time for the discussion of the affect of changes to the classification plan, but that the discussion must be limited to whether a public hearing date should be set.  Town Manager Michael C. Wood suggested tabling the decision on the public hearing until the next Town Council meeting.

Councilor William A. Andrews stated that he would like to rescind his motion and make another motion that this item be tabled.  Town Solicitor Walter J. Kane said that if the item is tabled and the Town Council wanted discussion, the agenda item would have to be broader than the current item.  He elaborated on the open meeting law passed by the State three years ago.  Councilor William A. Andrews stated that he would like to rescind his motion and make a motion to receive and file.  In a point of order from the audience it was stated that a motion that had been seconded could not be rescinded by the maker of the motion, but the Town Council would have to be vote to rescind.

Councilor Norman C. Mainville stated that there would be no reason to waste the time and advertising money on this if there is no intention to go ahead.  He indicated that he would vote to end it here.  

The Town Solicitor clarified, stating that, if she chose, Councilor Jacqueline Zahn could withdraw her second; and if he chose, Council William A. Andrews could then withdraw his motion and proceed with another motion.  

MOTION by Councilor Norman C. Mainville to move the question (of setting the date for the public hearing.)  The motion was defeated, three in favor, four opposed.  Voting in favor were Councilors William A. Andrews, Edward F. Bonczek and Jacqueline Zahn.  Voting against were Council President Wallace F. Lees and Councilors Louis Bleiweis, William E. Gonyea and Norman C. Mainville.

01-49   Introduction and first reading of proposed amendments to the General Ordinances of the Town of Burrillville entitled Zoning, §11-7.5 Home Occupations, as requested by Councilor Norman C. Mainville.

VOTED to receive and open.

Councilor Norman C. Mainville made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Discussion:  Councilor Norman C. Mainville stated that this item was to be referred to the ordinance subcommittee for review and recommendations.  He stated that, as he understood it, it has been difficult for the Building Official to determine what is a home occupation and what the limitations are.

VOTED to refer to the ordinance subcommittee.

01-50   Introduction and first reading of proposed amendments to the General Ordinances of the Town of Burrillville entitled Stop Signs, as requested by Councilor Norman C. Mainville.

VOTED to refer to the ordinance subcommittee.

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. 01-51   VOTED to receive and open the correspondence from Michael C. Wood, Town Manager, regarding Department/Division Head  COLA.

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Discussion:  Town Manager Michael C. Wood recommended that the Council approve two steps of a raise for all employees who are non-union department/division employees.  Councilor William A. Andrews said he believes it only fair to keep the department heads ahead of the employees.  Councilor Louis Bleiweis stated that he doesnt mind the raise, but has concerns about the incentive opportunities in the classification plan.  Councilor Jacqueline Zahn pointed out that the discussion is not on the incentive pay, but rather about a cost-of-living raise.

VOTED to go with the Town Managers plan for COLA increases.

01-52   VOTED to receive and open the correspondence from Walter J. Kane, Town Solicitor, regarding support of legislation requested by the Town Council.

Councilor William A. Andrews made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Discussion:  Town Solicitor Walter J. Kane reviewed that the items the Town Council requested State delegates introduce would be given more serious consideration if the Town Council passed resolutions requesting passage.  He outlined the resolutions that he drafted at the Councils request.

01-53   VOTED to support the resolution to amend RIGL §45-14-1(c)(4)(d) to allow a Zoning Board of Review to grant a dimensional variance where the use is permitted by a Special Use Permit and send it to the delegation of the representatives of the Town of Burrillville.

Councilor Norman C. Mainville made the motion.  Councilor William A. Andrews seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

01-54   VOTED to support the resolution to amend RIGL (Energy Facility Siting Act) §42-98-7(a)(2) by adding the following language:  The findings of local authorities regarding land use and zoning and their recommendation to the siting board shall be adhered to unless the siting board finds that there is a compelling state interest to overrule the recommendation of the local authorities and send the resolution to the delegation of the representatives of the Town of Burrillville.

Councilor William A. Andrews made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. 01-55   VOTED to support the resolution regarding amendment of the Policemens Bill of Rights so that the delegation knows that they have the support of the Town of Burrillville.

Councilor William A. Andrews made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. 01-56   VOTED to receive and open the correspondence from Walter J. Kane, Town Solicitor, regarding the resolution declaring Lee Circle and Whiting Lane as public highways; and advertising and setting the date of the public hearing.

Councilor William A. Andrews made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Discussion:  Councilor William A. Andrews asked whether these roads had been surveyed.  Town Solicitor Walter J. Kane said that they had and the Town Clerk would post the maps.  He further stated that, at the next meeting he would ask to schedule a public hearing at the latter part of April for all the other roads at Round Lake. These will be taken in as Town roads and be part of the Town program to resurface and do work on these roads.  

Councilor William A. Andrews asked about the width of the roads.  Walter J. Kane explained that in some cases the roadbed is actually over on private property.  When the reconstruction is done, he said, work would not be on private property, but will stay on Town property.

VOTED on the resolution declaring Lee Circle and Whiting Lane as public highways, to set the date of the public hearing for March 14, 2001 at 7:00 p.m.

01-57   VOTED to receive and open the memo from Michael C. Wood, Town Manager, regarding scheduling of a public hearing for consideration of roads for highway purposes.

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Discussion:  Mr. Kane said that a resolution would be submitted to the Town Council at the March 14, 2001 meeting.  The tentative date of April 30, 2001 at the Burrillville Middle School is acceptable.

VOTED to set the hearing date of April 30, 2001 at 7:00 p.m. at the Middle School.

01-58   VOTED to refer to the screening subcommittee the correspondence from Raymond A. Levesque regarding applications of Planning Board members Raymond A. Levesque, Michael S. Lupis and Jeffrey W. Partington for reappointment to the board.

01-59   VOTED to receive with regret the correspondence from Katia Balassiano, Planning Director, regarding the resignation of planning board member David LePage, and to send a letter of thanks to Mr. LePage.

Councilor William A. Andrews made the motion.  Councilor Norman C. Mainville seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. 01-61   VOTED to receive and file the correspondence from Kathleen M. Silvia, City Clerk of Newport, regarding support of the Newport City Council Resolutions No. 2001-016 and No. 2001-017.

Councilor Louis Bleiweis made the motion.  Councilor William A. Andrews seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

01-62   MOTION that the Council President represent the Town Council at the St. Patricks Day Parade in the City of Newport, RI.

Councilor Jacqueline Zahn made the motion.  Councilor Louis Bleiweis seconded the motion.  The motion was unanimously defeated.  Voting in opposition to the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.
