REGULAR MEETING of the Town Council held Wednesday, June 27, 2001 at 7:00 o'clock p.m. in the Council Chamber, Town Building, Harrisville, for and within the Town of Burrillville.

MEMBERS PRESENT:  Council President Wallace F. Lees; Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

MEMBERS ABSENT:  None

        1.      Council President Wallace F. Lees led those present in Pledging Allegiance to the flag.

        2.      VOTED to accept the minutes of the Regular Meeting of the Town Council held Wednesday, June 13, 2001, the Public Hearing Relative to Site Plan Review held June 13, 2001, and the question of dispensing with the reading of said minutes.

Councilor Norman C. Mainville made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  

        3.      Public Comment:

·       Richard Mulligan of Mapleville 2000 thanked the Town Council for voting a $500.00 donation to the committee under the cell tower contract.

·       William Flanagan thanked the Mainville family on behalf of his daughter, who was recently awarded the Norman H. Mainville Award.

        4.      That the General Good and Welfare of the Town of Burrillville; be now taken up.

·       Councilor Norman C. Mainville requested a letter of congratulations for Ellen Vermette, principal of Steere Farm Elementary School, upon her retirement.  He pointed out that Mrs. Vermette, among others, was responsible for coordinating the on-time opening of the school after the renovations were complete.

·       Councilor Norman C. Mainville commended the students and faculty of the Burrillville High School on the recent graduation.  He noted that the awarding of a diploma to a deceased student, Holly Brizzard, was a particularly moving moment.

·       William Flanagan and Cheri R. Hall, Director of Parks & Recreation, presented T-shirts to councilors, commemorating the 2001 Family Fair.  Mr. Flanagan spoke briefly about the success of the Family Fair.  On behalf of the Town Council, Councilor William E. Gonyea thanked the organizers of the Fair.

        5.      Petitions:  None

        6.      Special Business:  

01-179  VOTED to grant the applications from Kevin J. Mitchell d/b/a IBPOA and Burrillville Parks & Recreation for an entertainment license and a victualing license for a Family Fair to be held July 5  8, 2001; and waive licensing fees at the request of Cheri R. Hall, Director of Parks & Recreation, contingent upon settling the insurance issue to the satisfaction of the Town Manager; and that the fire chief be in attendance that evening and that fireworks would not be displayed without his approval.

Discussion:  John Costello of 2140 Broncos Highway, Glendale, raised the issue of fire safety during fireworks displays.  He explained that his concerns result from considerable debris that fell on his property during the last fireworks display.  Richard Mulligan stated that he has met with the Fire Department, who will check wind direction and all safety issues.  The Fire Department will not allow fireworks if conditions are inappropriate.  Mr. Costello also raised the health issue of parking trucks near wells.  Cheri R. Hall, director of parks & recreation, stated that the trucks have been instructed to stay 200 feet away from wells.  Additionally, Barbara VonVillas, Superintendent of Schools, asked whether the committee had submitted a formal building use request form.  Kevin Mitchell stated that it had been delivered to the School Department Administration Building.

Councilor Jacqueline Zahn made the motion.  Councilor William A. Andrews seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  

01-180  VOTED to refer the application from Vincent Rocco of 38 Grove St., Pascoag, for the renewal of private detective license #12 to the Town Solicitor.

Councilor Jacqueline Zahn made the motion.  Councilor Edward F. Bonczek seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  

01-181  VOTED to table the application from Ahmed Y. and Robin Abdulla d/b/a Jasons Diner for a victualing license to apply at 960 Victory Highway, Mapleville, in a building owned by Arthur Thibodeau (Assessors Map 196, Lot #13).

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  

        7.      Unfinished Business:  

01-98   VOTED to continue the discussion of the proposed addition to the A.T. Levy School to a special meeting on July 11, 2001, at the request of Barbara VonVillas, Superintendent of Schools.

Councilor Jacqueline Zahn made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  



01-172  VOTED to receive and open discussion of the resolution of the Town of Burrillville adopting the Fiscal Year Ending June 30, 2002 Proposed Operating Budget.

Councilor William A. Andrews made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  

Discussion:  Michael C. Wood reviewed the revisions to the proposed budget, taking into account the State aid, stating that the projected tax rate would be $18.94.  He discussed the affect of the revaluation on the tax rate, the application of $300,000 in interest to the budget to keep the tax rate manageable, and the flexibility for adjustments to the budget that would maintain the rate. He explained that the school budget that he originally recommended is still in the budget and elaborated on the effect that State aid has on the budget. Speaking generally, Michael C. Wood said that the financial management team has done a good job during a difficult budget year.  He referred to a list of possible 10-percent cuts that he had been asked to provide for the Town Councils review.

Councilor Jacqueline Zahn said she would not consider additional cuts at this time. She suggested restoring $10,000 for the Jesse Smith Library.

Councilor Louis Bleiweis praised the Finance Director and Town Manager for the budget.  He recommended adding $1,000 to the R.S.V.P. appropriation for the Meals on Wheels program and eliminating the incentive bonuses.

Councilor Edward F. Bonczek asked for clarification of the action the Town Council can take regarding the school department budget.  There was a brief discussion of the matter.

Councilor William A. Andrews reiterated that the Financial Management Team had done a good job on the budget, stating that he is in favor of incentive pay.  There was a brief discussion of longevity pay.

Councilor Norman C. Mainville stated his belief that it would be appropriate to review the incentive pay program, but that this is not the time for that discussion.  He commended the Town Manager, Finance Director and staff on a job well done.  He suggested taking a sum from the general fund that would be sufficient to maintain the tax rate, pointing out that this suggestion would be a one-time scenario.

Motion by Councilor Norman C. Mainville to transfer $320,000 from the general fund to apply to indebtedness.  The motion was not seconded.

Councilor William E. Gonyea read the following into the record:

As previously stated, my “nay” vote is to angrily protest the present tax system that, year after year, continues to tax the struggling middle class, the working poor, and the unfortunate, beyond their means; and I hope some day we can find a way, other than property taxes, to raise the necessary revenues to run our town and promote progress balanced with the peoples ability to pay.
Because of our majority average low-income status and the present tax system, along with state mandates, state aid shortfalls, contractual obligations, etc., I believe Mr. Wood has an impossible job to do.  Therefore, and for the record, I wish to commend him and all who assisted him in finalizing the budget that, in my opinion, comes close to holding the line on taxes, as much as reasonably can be, in these most difficult times.

Councilor Jacqueline Zahn suggested that the Town Council should consider increasing the Police Department budget sufficiently to purchase an additional vehicle.

William Flanagan of Nasonville stated his opinion that it would be inappropriate to cut incentive pay from the budget, since these employees have entered into a good faith agreement.  It would be more appropriate to allow the contracts to expire and review the contracts at that time.

Mr. Flanagan requested further explanation of the tax rate, relative to the previous year.  He asked several questions about the school department budget, the net increase to the municipal and school department budgets, and the percentage increases to each.   There was a brief discussion of each item under question. He stated his point that, though there is never sufficient contribution to the municipal budget, the school department must be looked at equally.  He recommended to the Town Council that they consider the Town Managers original budget for the school department.

Mary Jane Pelkey of Joslin Road referred to the Bloomberg Report that has been discussed during recent hearings.  She pointed out several newspaper articles related to increase in gas prices, job cuts, Federal tax cuts, etc.  She stated that the budget must be voted at this point, but suggested that this is also the appropriate time to start talking about ways to arrive at level funding for next year.

Roland Huguenin of Mohegan suggested a possible solution to the budget process:  it is necessary, he said, to work with a true budget; that is, what was spent last year, not the amount that was budgeted.

Raymond Trinque of Pascoag said that he agreed with Mr. Flanagan, that it is important to keep the (school) budget, as originally proposed.

VOTED to add $10,000 for the Jesse M. Smith Library.

Councilor Jacqueline Zahn made the motion.  Councilor William A. Andrews seconded the motion.  The motion passed, five in favor, two abstentions.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis and Norman C. Mainville.  Councilors Edward F. Bonczek and William E. Gonyea abstained.

VOTED to add $1,000 for R.S.V.P.

Councilor Jacqueline Zahn made the motion.  Councilor William A. Andrews seconded the motion.  The motion passed, five in favor, two abstentions.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis and Norman C. Mainville.  Councilors Edward F. Bonczek and William E. Gonyea abstained.

MOTION by Councilor Jacqueline Zahn to add $25,000 to the Police Department budget for a new vehicle.  There was no second to the motion.

VOTED to add $2,500 to the Town Council budget for conferences and seminars.

Councilor Jacqueline Zahn made the motion.  Councilor Norman C. Mainville seconded the motion.  The motion passed, five in favor, two abstentions.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis and Norman C. Mainville.  Councilors Edward F. Bonczek and William E. Gonyea abstained.

VOTED to add $400 to the Town Council budget for dues and fees.
Councilor Jacqueline Zahn made the motion.  Councilor Louis Bleiweis seconded the motion.  The motion passed, five in favor, two abstentions.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis and Norman C. Mainville.  Councilors Edward F. Bonczek and William E. Gonyea abstained.

VOTED to add $2,00 to the Town Clerks professional/technical budget.

Councilor Jacqueline Zahn made the motion.  Councilor Norman C. Mainville seconded the motion.  The motion passed, five in favor, two abstentions.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis and Norman C. Mainville.  Councilors Edward F. Bonczek and William E. Gonyea abstained.

MOTION to cut $25,000 from the budget for bonus incentives.

Councilor Louis Bleiweis made the motion.  Councilor Norman C. Mainville seconded the motion.  The motion failed, one in favor, five in opposition, and one abstention.  Voting in favor of the motion was Councilors Louis Bleiweis.  Voting in opposition were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Edward F. Bonczek and Norman C. Mainville.  Councilor William E. Gonyea abstained.

Michael C. Wood, Town Manager, summarized the budget process for this year.  He stated that the high school project, which was voted by the people, added 1.1 million dollars to the budget; pointed out that this years revaluation created considerable confusion; said that debt service in Burrillville has been a long-standing problem; and described the affect on the budget of school department contracts and decisions.  This Council and the Finance Department, according to Michael C. Wood, have made progress on debt service by reissuing debt and taking other administrative steps. However, issues that have taken many years to develop will require time to resolve.

Roland Huguenin of Mohegan questioned how the school budget could increase while there is a decrease in the school population.

VOTED at 8:50 p.m. to recess for 15 minutes to allow for adjustments to the budget resolution to allow for the preceding votes of the Town Council.

Councilor Jacqueline Zahn made the motion.  Councilor Norman C. Mainville seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  

The meeting resumed at 9:05 p.m.

VOTED to send letters to the legislative delegation, thanking them for their efforts in securing funding on the local level for both the municipality and the schools.

Councilor Norman C. Mainville made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. VOTED to adopt the budget resolution.

FINAL ADOPTED BUDGET (JUNE 27, 2001)
BUDGET RESOLUTION  Fiscal Year Ending June 30, 2002

SECTION A.
        That a resolution of the Town of Burrillville adopting the annual Town Budget for the 2001-2002 Fiscal Year be adopted.
        Whereas, the Burrillville Town Charter provides in Article Ten for the budget process and specifically in Section 10.04 (F) for the final adoption of the Town Budget including School Operations.
        And whereas, the final budget when adopted shall show a balance between authorized appropriation and anticipated receipts.
        Now, therefore, be it resolved that the Town Council adopts a final budget for the 2001-2002 Fiscal Year of $ 37,161,639.  This total budget is divided into the following Sections:  $ 6,616,954 for Municipal Operations, $ 6,080,017 for Debt Service, $ 1,709,668 for Capital Improvements, $22,055,000 for School Operations (See **NOTE 1), and $ 700,000 for the Overlay Variance.

The Total Appropriation of $ 37,161,639 is broken down as follows:

(1)     Total Town Operating Appropriation:     $ 6,616,954
(2)     Total Town Indebtedness and Interest Appropriation:     $ 6,080,017
(3)     Total Town Capital Improvement Appropriation:   $ 1,709,668     **NOTE 4
(4)     Total School Department Appropriation:  $ 22,055,000    **NOTE 1
(5)     Overlay Variance Appropriation for Tax Abatements,

        The Total Adopted Departmental Budgets as recommended by the Town Manager, and amended by the Town Council, for the 2001-2002 Fiscal Year is attached and incorporated as part of this resolution.

SECTION B.
        That the Town Council hereby orders the assessment and collection of a tax on ratable real estate and tangible personal property in a sum not less than  $15,504,356, and not more than $16,204,356, based upon current estimated assessed valuations.

The Total Revenues allocated for Town and School Expenditures are broken out as follows:

        All tax classifications shall be granted the same tax dollar exemption credit using the rates set by the Town Council.  Where applicable, tax dollar credits shall apply to real estate first and motor vehicles second.
Any and all revenue/receipts (prior and current fiscal year ending 2002) shall be considered to be part of the general receipts of the Town and shall not supplement nor increase the amount appropriated to a specific department by the Town Council.  This does not apply to direct reimbursements (e.g. insurance, grants, cancelled orders).       
        If state aid for education should be higher than anticipated in this Resolution, and the school budget adopted herein provides for an increase in town funds that is greater than the amount of increased unrestricted state aid for education then the additional state aid shall be used to reduce the amount to be raised from town taxes and the tax rate shall be adjusted accordingly.  If the amount appropriated by the town for the School Department is less than the increase in unrestricted school aid then a portion of the increased state aid shall be appropriated to the School Department so that the total school appropriation is equal to the amount of the increase in unrestricted state school aid.
Municipal department expenses incurred during their normal operation that will result in the over expenditure of a given municipal departments appropriation for the given year shall be balanced through transfers from the General Fund Contingency line item by the Finance Director who shall notify the Town Council of any transfer at the next Town Council meeting.
        Now, therefore, be it further resolved, that the tax levy WILL NOT exceed the five and one-half percent annual cap as imposed by the Omnibus Property Tax Relief and Replacement Act of 1985, Chapter 44-5-2 of the General Laws of the State of Rhode Island, as amended.
        Said Taxes are for ordinary expenses, the payment of Town interest and indebtedness in whole or in part, the payment of the Towns proportion of the State Tax, and for other purposes authorized by law.
        The Tax Assessor having assessed and apportioned said tax on the ratable property of said Town as of the 31st day of December 2000 at Twelve oclock midnight, according to law, and shall on completion of said assessment, date, certify and sign the same and deliver to and deposit the same in the office of the Town clerk, on or before June 15, 2001.  The Town Clerk on receipt of said assessment, shall forthwith make a copy of the same and deliver it to the Town Treasurer/Finance Director who shall forthwith issue and affix to said copy, a warrant under his hand, directed to the Collector of Taxes of said Town, commanding him to proceed and collect said tax of the persons and estates liable therefore, said tax shall be due and payable on the 15th day of July, 2001.
Said tax may be paid in equal quarterly installments, the first installment of 25 per centum on or before the 1st day of August 2001 and the remaining installments as follows:

        25 per centum on the 1st day of November  2001
        25 per centum on the 1st day of February 2002
        25 per centum on the 1st day of May 2002

        Each installment of taxes if paid on or before the 1st day of each installment period successively and in order shall be free from any charges for interest.
        If the first installment or any succeeding installment of taxes is not paid by the last day of the respective period or periods as they occur, then the whole tax or remaining unpaid balance of the tax as the case may be shall immediately become due and payable and shall carry until collected a penalty at the rate of Twelve (12) per centum per annum from August 1, 2001.
        This Resolution adopting the Budget for Fiscal Year Ending June 30, 2002 will become effective July 1, 2001 unless amendments are made prior to July 1, 2001.

**NOTE 1.       The School Department Expenditure and Revenue Appropriation does not incorporate State Aid targeted for the following programs: Student Equity, Technology, Literacy, Kindergarten, Vocational Education, Early Childhood, Language Investment, and Professional Development, which shall be received by the Town Treasurer and accounted for separately by the School Department.
**NOTE 4        The total Town Capital Improvement Appropriation and the source of funds to support it adopted by the Burrillville Town Council on April 11, 2001 is incorporated herein.
**NOTE 3        This amount shall include any reimbursement pursuant to R.I.G.L. §44-34.1-2 recognized for the fiscal year 2001/2002.  Such sum is calculated as the difference between the levy received locally and the amount calculated by the Director of Administration to be the difference if the repeal of the motor vehicle excise tax had not been enacted.  

Councilor William A. Andrews made the motion. Councilor Louis Bleiweis seconded the motion.  The motion passed, five in favor, one opposed, one abstention.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews and Edward F. Bonczek.  Councilor Louis Bleiweis voted in favor of adoption, with the exception of the one item that he protested. Voting in opposition was Councilor Norman C. Mainville.  Councilor William E. Gonyea abstained.

Note:  Note 2 from the proposed resolution was not included in the final resolution.  It does not apply.

8.      New Business:

01-182  VOTED to receive and open the correspondence from John P. Mainville, Finance Director, regarding adjustments of exemptions upon revaluation of real property pursuant to ordinance 2-4.6.

Councilor William A. Andrews made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  

Discussion:  John P. Mainville, Finance Director, explained that this item is to bring the exemptions in-line with the results of the revaluation.  

VOTED that the proposed increase in personal exemptions, per the attached schedule, be adopted and effective for this tax year (2001) (fiscal year ending June 30, 2002 and assessment year ending December 31, 2000). Exemptions: Blind from 11,500 to 14,000; Senior from 7,200 to 8,700; Gold Star from 5,400 to 6,500; Brown University from 10,000 to 12,100; Veteran from 7,200 to 8,700; 100% Disabled from 10,000 to 12,100; POW from 27,000 to 32,700; 100% Disabled 9,000 to 10,900; Adapted Housing from 18,000 to 21,800; and Disability-Social Security from 5,400 to 6,500.

Discussion:  William Flanagan asked about the exemption for Brown University professors.  There was a discussion that the exemption is State law; the amount is adjusted by local jurisdiction.  It has been the practice that all exemptions are adjusted across the board.  The adjustment is to allow the person to save approximately the same number of tax dollars as under the old valuation.  

Councilor Jacqueline Zahn made the motion.  Councilor Norman C. Mainville seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  

01-183  VOTED to receive and open the correspondence from John P. Mainville, Finance Director, regarding the transfer of reserve funds.

Councilor William A. Andrews made the motion.  Councilor William E. Gonyea seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  

Discussion:  Michael C. Wood, Town Manager, explained that this is to put monies into accounts that have been set up it recent years.  This is money rolled over from one fiscal year to the next.

VOTED that the following reserve funds be increased via transfer from the Towns Unreserved, Undesignated General Fund Balance  Economic Development/Redevelopment Fund ($50,000), Unfunded Liability  Sick and Vacation Fund ($50,000), Open Space/Recreation Land Acquisition ($100,000), and Major Capital Fund $200,000).  Note:  The transfer of these funds requires the affirmative vote of six (6) Council members due to the appropriation of funds from the Unreserved, Undesignated General Fund Balance [Town Charter 3.14 (j)].

Councilor Jacqueline Zahn made the motion.  Councilor Norman C. Mainville seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

11.     Additional New Business to be considered and acted upon:  

01-184  VOTED to grant the request for Executive Session from Town Manager Michael C. Wood pursuant to Rhode Island Open Meeting Law [42-46-5(a)(5)] to discuss the acquisition of land at 216 Harrisville Main St, Map 160, Lot 74.

Councilor Norman C. Mainville made the motion.  Councilor Jacqueline Zahn seconded the motion.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.  

The Council returned to open session. Councilwoman Jacqueline Zahn announced that no votes had been taken.  

VOTED to seal the minutes of the executive session; there was one vote taken.
