Regular Meeting 10-09-2002
REGULAR MEETING of the Town Council held Wednesday, October 9, 2002 at 7:00 o’clock p.m. in the Council Chamber, Town Building, Harrisville, for and within the Town of Burrillville.

MEMBERS PRESENT:  Council President Wallace F. Lees; Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

MEMBERS ABSENT:  None

Council President Wallace F. Lees led those present in pledging allegiance to the flag.

VOTED to accept the minutes of the Regular Meeting, Workshop and Public Hearing of the Town Council held Wednesday, September 25, 2002, and to dispense with the reading of said minutes.

Motion by Councilor William E. Gonyea.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Public Comment:  None

General Good and Welfare of the Town of Burrillville.

Councilor Norman C. Mainville mentioned a meeting with Tennessee Gas, which he, Council President Wallace F. Lees and Town  Manager Michael C. Wood attended on October 8, 2002.  He found the meeting informational and was impressed at the low sound level of the new equipment.  He stated his impression that the facility will be a good source of revenue and a good neighbor.

New Business:

02-263  VOTED to receive and open the correspondence from James R. Drew, Tax Assessor, regarding his request for a workshop relative to a comprehensive review of exemptions.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William E. Gonyea.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Discussion:  Michael C. Wood, Town Manager, stated that the Town Council has discussed a review of exemptions and that the ordinance subcommittee has considered the matter.  The administration has a number of suggestions to present to the Town Council for prioritization.  A workshop will be scheduled, at the call of the Council President.

VOTED to receive and file.
Motion by Councilor William A. Andrews.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

02-264  VOTED to receive and open the correspondence from Brian P. Lanoie, Harrisville, regarding the request of the Fiddlers Green Homeowners Association that a regarding schedule be implemented for the subdivision located on Pinewood Lane.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Norman C. Mainville.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Discussion:  Brian P. Lanoie, President of the Fiddlers Green Homeowners’ Association, explained that the association is asking the town for assistance in maintaining the road, as explained in his letter of September 26, 2002.  In response to a question from Councilor Edward F. Bonczek, Mr. Lanoie said that the association would agree to place a time limit on the assistance.  Councilor Norman C. Mainville recommended that the association meet with the Town Manager to establish compensation for Town equipment and manpower.  Michael C. Wood, Town Manager, stated the issues to be resolved, included whether the association would provide legal waivers; Mr. Lanoie agreed that they would.

VOTED to refer to the Town Manager.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William A. Andrews.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

VOTED to take item 02-265 and 02-266 together, and to enter into the record the September 26, 2002 correspondence from Col. Bernard E. Gannon, Chief of Police.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Discussion:  Councilor Norman C. Mainville voiced concerns that these resignations were a reaction to the board being unable to meet and recommended that the personnel board be asked to review the board.

02-265  VOTED to receive with regret the correspondence from Richard E. Tramonti regarding his resignation from the Juvenile Hearing Board, and to refer the matter to the Screening Subcommittee.

Motion by Councilor William A. Andrews.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

02-266  VOTED to receive with regret the correspondence from Richard A. Aubin regarding his resignation from the Juvenile Hearing board, and to refer the matter to the Screening Subcommittee.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William E. Gonyea.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

02-267  VOTED to appoint Robert A. Mellion as second auxiliary member of the Zoning Board of Review, for a term to expire March 31, 2002, as recommended by the Screening Subcommittee.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Louis Bleiweis.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

02-268  VOTED to appoint Kevin Cleary to the Burrillville Conservation Commission, for a term to expire March 31, 2005, as recommended by the Screening Subcommittee.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Norman C. Mainville.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

02-269  VOTED to appoint JoAnn Desrocher to the Juvenile Hearing Board, for a term to expire January 31, 2003, as recommended by the Screening Subcommittee.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Norman C. Mainville.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

9.      Town Clerk/Communication:

02-270  VOTED to receive and file the correspondence from the Rhode Island Department of Environmental Management regarding insignificant alteration permit, application #02-0274.

Motion by Councilor William E. Gonyea.  Seconded by Councilor Norman C. Mainville.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

Additional New Business:

02-271  VOTED to grant the request for Executive Session from Michael C. Wood, Town Manager, pursuant to Rhode Island Open Meeting Law [§42-46-5(a)(5)] for discussion or considerations related to the acquisition, sale and exchange of real property, [§42-46-5(a)(5)] to discuss the disposition of publicly held property and [§42-46-5(a)(2)] for discussions related to collective bargaining for IBPO Local 369.

Motion by Councilor William E. Gonyea.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

The Council returned to Open Session at 7:25 p.m.  Councilor Jacqueline Zahn announced that no votes had been taken.

VOTED to seal the minutes of the executive session.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.

VOTED to adjourn at 7:25 p.m.

Motion by Councilor Norman C. Mainville.  Seconded by Councilor Jacqueline Zahn.  The vote was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, William E. Gonyea and Norman C. Mainville.
