SPECIAL MEETING of the Town Council held Monday, November 22, 2004 at 1:22 o’clock P.M. in the Council Chamber, Town Building, 105 Harrisville Main St., Harrisville for and within the Town of Burrillville.
MEMBERS PRESENT: Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Louis Bleiweis, Edward F. Bonczek, Ronald E. Faford and William E. Gonyea.
MEMBERS ABSENT: None
1. That the following renewals of Alcoholic Beverage Licenses under provision of Title 3, Chapter 7, GENERAL LAWS of Rhode Island, 1956, as amended, for the period beginning December 1, 2004 and ending November 30, 2005.
1. Obtaining a Certificate of Good Standing from the State Division of Taxation prior to the date of said renewal, and
2. The payment of taxes owed to the Town of Burrillville, and
3. The establishment being in compliance with all state and local building and fire codes.
4. Copy of certification from the Rhode Island Department of Health.

Discussion: It was noted that the Town Council had received a letter from the Nasonville Fire Department indicating that AJAR, Inc. was substantially in compliance with the fire code.
VOTED to grant a class B(V) liquor license to AJAR, INC. d/b/a Western Hotel Pizza & Tavern, in building owned by Albert and Roxanne Mottola, 610 Douglas Turnpike, Nasonville (Assessors’ Map 131, Lot 42), subject to receipt of Certificate of Good Standing.

Further Discussion: Walter J. Kane, Town Solicitor, indicated that he understood Michael C. Wood, Town Manager’s opposing the renewal of licenses when the business did not demonstrate that they hold worker’s compensation and/or liability insurance. However, Mr. Kane stated his opinion that, under current State law, the Town cannot require insurance as a condition of renewal. Mr. Kane suggested that the town ordinance relative to entertainment licenses could be amended to require insurance.

Further Discussion: Walter J. Kane, Town Solicitor, explained that the Village Barn had not completed work to renew their food handling license. He suggested that the Town Council could approve the license, but that the license not be issued until a certification had been received from the Rhode Island Department of Health.

Further Discussion: Walter J. Kane, Town Solicitor, explained that Videtta Gold Management, LLC, has two liquor licenses, a class B(V) and a class C. Mr. Kane indicated that the law allows for only one license for a premise. Michael Videtta explained that the Class C license is used for another building on the same property. It was suggested that the B(V) license could apply at both buildings.

Licensees who plan to remain open must notify the Chief of Police, Colonel Bernard E. Gannon on or before November 30, 2004.
