12-01-2004 Council - Organizational Meeting
MEETING of the Town Council, being the Organizational Meeting, held Wednesday, December 1, 2004 at 7:00 o'clock p.m. in the Council Chamber, Town Building, Harrisville, for and within the Town of Burrillville.

MEMBERS PRESENT:  Councilors William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford, William E. Gonyea, Wallace F. Lees and Jacqueline Zahn.

MEMBERS ABSENT:  None

        1.      That in accordance with Article III, Section 3.01 and Section 3.02 entitled Town Council of the Town Charter, the Town Council shall meet this day for the purpose of entering upon their respective duties and for the appointment and approval of such Town Offices as are by law made elective by the Town Council; and that the oath of office shall be administered to all newly elected town officials.

Council President Wallace F. Lees called newly elected officials forward and asked Walter J. Kane, Town Solicitor to administer the oath of office.  Councilors Nancy F. Binns, Margaret L. Dudley and William E. Gonyea and School Committee members Joan Cote and Peter Lambert swore the oath of office. Walter J. Kane congratulated the newly elected briefly spoke of the importance of the roles of the elected officials.  Mr. Kane expressed his respect for present and past elected officials of the Town of Burrillville who, he said, truly represent the community in the manner that Americans expect of their elected officials.

Council President Wallace F. Lees noted that Dorothy Cardon, who had been elected to the School Committee, was unable to attend the meeting but had taken the oath of office earlier.

        2.      The clerk entertained nominations for President of the Town Council.  Wallace F. Lees was nominated by Jacqueline Zahn.  

VOTED to close nominations.

Motion by Councilor William A. Andrews.  Seconded by Councilor William E. Gonyea.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

VOTED that in accordance with Article III, Section 3.08 of the Town Charter, Councilor Wallace F. Lees be and hereby is appointed President of the Town Council.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        3.      Wallace F. Lees, Town Council President, entertained nominations for Vice President of the Town Council.  Jacqueline Zahn was nominated by William E. Gonyea.  

VOTED to close nominations.

Motion by Councilor William A. Andrews.  Seconded by Councilor William E. Gonyea.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

VOTED that in accordance with Article III, Section 3.08 of the Town Charter, Councilor Jacqueline Zahn be and hereby is appointed Vice President of the Town Council.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William A. Andrews.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        4.      VOTED that in accordance with Article VII, Section 7.01 of the Town Charter, Walter J. Kane shall be appointed Town Solicitor to serve at the pleasure of the Town Council.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Ronald E. Faford.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        5.      VOTED that in accordance with Article VII, Section 7.01 of the Town Charter, William L. Bernstein, Nichole Carroll, Patrick J. Dougherty and Timothy F. Kane shall be designated as Assistant Town Solicitors; and that the attorney selected by the School Committee shall be appointed Assistant Town Solicitor, at the request of Town Solicitor Walter J. Kane; and that Jeffrey W. Kasle shall be designated as Special Counsel for Labor Relations.

Motion by Councilor William E. Gonyea.  Seconded by Councilor Ronald E. Faford.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        6.      VOTED that in accordance with Article VI, Section 6.02 of the Town Charter, Pierre G. Rondeau shall be appointed Judge of Probate for the ensuing two years, term of office to be concurrent with that of the Town Council.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William E. Gonyea.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        7.      VOTED that in accordance with Chapter XV, Section 15-7(f) of the General Ordinances of the Town of Burrillville, Joseph P. Carroll shall be appointed Judge for the Municipal Court.  The term of appointment shall be for two (2) years, terminating on December 31, 2006.

Motion by Councilor William A. Andrews.  Seconded by Councilor Ronald E. Faford.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        8.      VOTED that in accordance with Chapter XV, Section 15-7(f) of the General Ordinances of the Town of Burrillville, Richard E. Kyte, Jr. shall be appointed Associate Judge for the Municipal Court.  The term of appointment shall be for two (2) years, terminating on December 31, 2006.  

Motion by Councilor William E. Gonyea.  Seconded by Councilor William A. Andrews.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        9.      VOTED that by virtue of his office as President of the Town Council of the Town of Burrillville Wallace F. Lees be and he hereby is a member of the Board of Administration.
                
Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William A. Andrews.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        10.     VOTED that in accordance with a Trustee Deed recorded by the late Austin T. Levy and recorded in Deed Book 43, Page 372 to 382 inclusive, of the Records of Deeds in the Town of Burrillville, Council President Wallace F. Lees be and he hereby is appointed Chairman of the Board of Administration.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        11.     VOTED to open discussion of the appointment of three (3) members of the Town Council Ordinance Subcommittee.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William E. Gonyea.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

Discussion:  Councilor Jacqueline Zahn indicated that she had reconsidered her request to serve on this subcommittee and noted that Councilor Margaret L. Dudley might be interested.

VOTED to appoint Councilors William A. Andrews, Margaret L. Dudley and Ronald E. Faford to the Town Council Ordinance Subcommittee.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William A. Andrews.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        12.     VOTED to appoint Councilors William A. Andrews, Wallace F. Lees and Jacqueline Zahn to the Town Council Screening Subcommittee.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Ronald E. Faford.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        13.     VOTED to receive and open the discussion of establishing an Administrative Audit Committee.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William E. Gonyea.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

Discussion:  Michael C. Wood, Town Manager, reported on discussions among Mark V. Caccia of Cayer Caccia LLP, John Mainville, Finance Director and himself relative to establishing a process for reviewing the auditing system throughout the year.  It was recommended that an administrative committee could be established on which members of the Town Council could serve, the purpose of which would be to review the general financial situation and condition of the Town.

VOTED to continue to the regular meeting of the Town Council scheduled for December 8, 2004 discussion of establishing an Administrative Audit Committee.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William A. Andrews.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        14.     VOTED to open for discussion the appointment of a liaison between the Town Council and the Burrillville Organization for Substance Abuse Prevention (BOSAP).

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William A. Andrews.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

Discussion: Councilor Jacqueline Zahn indicated an interest in serving in this position.

VOTED to appoint Councilor Jacqueline Zahn liaison between the Town Council and the Burrillville Organization for Substance Abuse Prevention (BOSAP).

Motion by Councilor William A. Andrews.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        15.     VOTED to open for discussion the appointment of a liaison between the Town Council and the Downtown Pascoag Neighborhood Association (DPNA).

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William A. Andrews.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

Discussion:  Councilor Nancy F. Binns indicated an interest in serving in this position.

VOTED to appoint Councilor Nancy F. Binns as liaison between the Town Council and the Downtown Pascoag Neighborhood Association (DPNA).

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F.         16.     VOTED to appoint Councilor Jacqueline Zahn liaison between the Town Council and the Burrillville Extended Care.

Motion by Councilor William A. Andrews.  Seconded by Councilor William E. Gonyea.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        17.     VOTED to appoint Councilor Margaret L. Dudley liaison between the Town Council and the Burrillville Housing Authority.  

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William E. Gonyea.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        18.     VOTED to open for discussion the appointment of a liaison between the Town Council and the Burrillville Industrial Foundation.  

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William E. Gonyea.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

Discussion:  Councilor William A. Andrews volunteered to serve in this position.

VOTED to appoint Councilor William A. Andrews liaison between the Town Council and the Burrillville Industrial Foundation.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F.         19.     VOTED to appoint Council President Wallace F. Lees liaison between the Town Council and the Jesse M. Smith Memorial Library.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor William E. Gonyea.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        20.     VOTED to appoint Ronald E. Faford liaison between the Town Council and the Planning Board.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        21.     VOTED to appoint Nancy F. Binns liaison between the Town Council and the Burrillville Recreation Commission.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        22.     VOTED to appoint Ronald E. Faford liaison between the Town Council and the School Committee.

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        23.     VOTED to appoint William E. Gonyea liaison between the Town Council and the Burrillville Senior Citizens.  

Motion by Councilor Jacqueline Zahn.  Seconded by Councilor Margaret L. Dudley.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        24.     VOTED to appoint William E. Gonyea liaison between the Town Council and the Sewer Commission.  

Motion by Councilor William A. Andrews.  Seconded by Councilor Ronald E. Faford.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        25.     VOTED to appoint William E. Gonyea liaison between the Town Council and the Zoning Board of Review.

Motion by Councilor William A. Andrews.  Seconded by Councilor Ronald E. Faford.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.  

        26.     VOTED to adjourn at 7:19 p.m.

Motion by Councilor William E. Gonyea.  Seconded by Councilor Jacqueline Zahn.  The motion was unanimous.  Voting in favor of the motion were Council President Wallace F. Lees, Councilors Jacqueline Zahn, William A. Andrews, Nancy F. Binns, Margaret L. Dudley, Ronald E. Faford and William E. Gonyea.
