PUBLIC HEARING of the Town Council held Wednesday, November 14, 2007 at 7:32 P.M. in the Council Chamber, Town Building, Harrisville for and within the Town of Burrillville.
PRESENT: Council President Nancy F. Binns, Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe
MEMBERS ABSENT: None
Relative to considering and acting on the following proposed changes to the Revised General Ordinances of the Town of Burrillville:
The Town Council of the Town of Burrillville hereby ordains as follows:
The General Ordinances of the Town of Burrillville are hereby amended by adding the following to Chapter 4. entitled Animals, §4-44. Dog waste.
NOTE: The notice of hearing was advertised in the legal section of the Woonsocket Call on Wednesday, November 7, 2007.
1. Comments/Input/Recommendation from the Ordinance Subcommittee
Councilor Margaret L. Dudley, Chair, Ordinance Subcommittee reported that amendments originally came before the Ordinance Subcommittee as a result of the Goals & Objectives meeting. Councilor Dudley said the intent of the proposal was to require people walking dogs to pick up after them, particularly in private yards and in the public parks.
Councilor Dudley noted that on the public hearing held September 12, 2007, the Town Council had recommitted the ordinance to the Subcommittee for further study. Councilor Dudley indicated that the ordinance subcommittee had reviewed the proposal and removed the word "certified" which had been included before the words "working dog".
Councilor Dudley indicated that the Ordinance Subcommittee recommended passage.
2. Comments/Input/Recommendations by the Administration (Town Solicitor, Town Manager, Administrative Staff)
Timothy F. Kane, Town Solicitor, indicated that the ordinance was straightforward and self-explanatory.
3. Proponents:
Cheri R. Hall, Director of Parks and Recreation, supported passage.
Kerry Courtemanche of Burrillville Animal Control recommended that language be added to require that people carry tools for cleaning up after their dogs.

5. VOTED to close the public hearing.
Motion by Councilor Norman C. Mainville. Seconded by Councilor Wallace F. Lees. The vote was unanimous. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.

7. Consider and take action on amending to the Revised General Ordinances of The Town of Burrillville 2004, Chapter 4. entitled Animals by adding §4-44. Dog waste.
VOTED to adopt the ordinance, as revised, as follows:
The Town Council of the Town of Burrillville hereby ordains as follows:
The General Ordinances of the Town of Burrillville are hereby amended by adding the following to Chapter 4. entitled Animals:
§4-44. Dog waste.
(a) It shall be unlawful for any person to fail to promptly remove and dispose of, in a sanitary manner, feces left by a dog being handled by that person on property, public or private, other than the premises of the owner or handler of such dog.
(b) The provisions of this section shall not apply when the dog involved is a working dog trained to assist disabled individuals.
This ordinance will take effect 10 days after passage.
Motion by Councilor Kevin M. Blais. Seconded by Councilor John M. Karmozyn, Jr. The motion carried, six in favor, one opposed. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., and Cynthia L. Roe. Councilor Norman C. Mainville voted in opposition.
8. VOTED to adjourn at 7:36 P.M.
Motion by Councilor Cynthia L. Roe. Seconded by Councilor John M. Karmozyn, Jr. The vote was unanimous. Voting in favor of the motion were Council President Nancy F. Binns and Councilors Wallace F. Lees, Kevin M. Blais, Margaret L. Dudley, John M. Karmozyn Jr., Norman C. Mainville and Cynthia L. Roe.
