SPECIAL MEETING of the Town Council being the Organizational Meeting, held Wednesday, December 3, 2008 at 7:00 P.M. at Burrillville High School, 425 East Avenue, Harrisville, for and within the Town of Burrillville.
PRESENT: Nancy F. Binns, Kevin M. Blais, Margaret L. Dudley, Kevin D. Heitke, John M. Karmozyn Jr., Wallace F. Lees and Norman C. Mainville
Note: Councilor Kevin M. Blais informed the Town Council that the assistive listening device provided was not sufficient for his use and that he would not participate in the meeting.
MEMBERS ABSENT: None
Organization of the Burrillville Town Council:
1. That in accordance with Article III, Section 3.01 and Section 3.02 entitled Town Council of the Town Charter, the Town Council shall meet this day for the purpose of entering upon their respective duties and for the appointment and approval of such Town Offices as are by law made elective by the Town Council.
The oath of office was administered to Councilors-Elect Nancy F. Binns, Margaret L. Dudley, and Kevin D. Heitke and School Committee Members-Elect Dorothy Cardon, Joan Cote and Debra Stockwell.
2. The clerk entertained nominations for President of the Town Council. Councilor Nancy F. Binns was nominated by Councilor Wallace F. Lees. Councilor Wallace F. Lees was nominated by Councilor Norman C. Mainville. Councilor Lees declined the nomination.
MOTION that in accordance with Article III, Section 3.08 of the Town Charter, Councilor Nancy F. Binns be and hereby is appointed President of the Town Council on a unanimous vote. The motion carried, six in favor, one abstention. Voting in favor of the motion were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
3. The clerk entertained nominations for Vice President of the Town Council. Councilor Wallace F. Lees was nominated by Councilor Norman C. Mainville.
VOTED to close nominations.
Motion by Councilor Norman C. Mainville. Seconded by Councilor Margaret L. Dudley. Voting in favor of the motion were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.

4. VOTED that in accordance with Article VII, Section 7.01 of the Town Charter, Timothy F. Kane be appointed Town Solicitor to serve at the pleasure of the Town Council. Voting in favor of the motion were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
5. VOTED to accept the recommendation of Timothy F. Kane, Town Solicitor, that William L. Bernstein, Patrick J. Dougherty, Nichole Carroll-Barnes and Walter J. Kane be designated as Assistant Town Solicitors; and that Jeffrey W. Kasle be designated as Special Counsel for Labor Relations.
Motion by Councilor Margaret L. Dudley. Seconded by Councilor John M. Karmozyn, Jr. The motion carried, six in favor, one abstention. Voting in favor of the motion were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
6. VOTED that in accordance with Article VI, Section 6.02 of the Town Charter, Pierre G. Rondeau be appointed Judge of Probate for the ensuing two years, term of office to be concurrent with that of the Town Council.
Motion by Councilor Norman C. Mainville. Seconded by Councilor Wallace F. Lees. The motion carried, six in favor, one abstention. Voting in favor of the motion were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
7. VOTED that in accordance with Chapter XV, Section 15-7(f) of the General Ordinances of the Town of Burrillville, Joseph P. Carroll be appointed Judge for the Municipal Court. The term of appointment shall be for two (2) years, terminating on December 31, 2010.
Motion by Councilor Wallace F. Lees. Seconded by Councilor John M. Karmozyn, Jr. The motion carried, six in favor, one abstention. Voting in favor of the motion were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
8. VOTED that in accordance with Chapter XV, Section 15-7(f) of the General Ordinances of the Town of Burrillville, Richard E. Kyte, Jr. be appointed Associate Judge for the Municipal Court. The term of appointment shall be for two (2) years, terminating on December 31, 2010.
Motion by Councilor Wallace F. Lees. Seconded by Councilor Norman C. Mainville. The motion carried, six in favor, one abstention. Voting in favor of the motion were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
9. VOTED that by virtue of her/his office as President of the Town Council of the Town of Burrillville Council President Nancy F. Binns be and she hereby is a member of the Board of Administration.
Motion by Councilor Norman C. Mainville. Seconded by Councilor John M. Karmozyn, Jr. The motion carried, six in favor, one abstention. Voting in favor of the motion were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
10. VOTED that in accordance with a Trustee Deed recorded by the late Austin T. Levy and recorded in Deed Book 43, Page 372 to 382 inclusive, of the Records of Deeds in the Town of Burrillville, Council President Nancy F. Binns be and she hereby is appointed Chairman of the Board of Administration.
Motion by Councilor Wallace F. Lees. Seconded by Councilor John M. Karmozyn, Jr. The motion carried, six in favor, one abstention. Voting in favor of the motion were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
11. Ordinance Subcommittee: Council President Nancy F. Binns and Councilors Margaret L. Dudley and Kevin D. Heitke were nominated for appointment to the Town Council Ordinance Subcommittee by Councilor Wallace F. Lees and Councilor Norman C. Mainville was nominated as an alternate member by Councilor Margaret L. Dudley. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
12. Town Council Screening Subcommittee. Councilors Wallace F. Lees, John M. Karmozyn, Jr., and Norman C. Mainville were nominated for the Screening Subcommittee and Councilor Kevin D. Heitke was nominated as the alternate member of the Screening Subcommittee by Councilor Norman C. Mainville. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
13. Administrative Audit Committee. Councilors Margaret L. Dudley and Norman C. Mainville were nominated for the Administrative Audit Committee by Councilors Wallace F. Lees and John M. Karmozyn, Jr. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
14. B-PAC. Councilor Margaret L. Dudley was nominated as liaison to the Burrillville Prevention Action Coalition (B-PAC) by Councilors Kevin D. Heitke and Norman C. Mainville. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
15. Downtown Pascoag Neighborhood Association: Councilor Norman C. Mainville was nominated as liaison to the Downtown Pascoag Neighborhood Association (DPNA) by Councilors Margaret L. Dudley and Wallace F. Lees. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
16. VOTED to continue the question of appointing a liaison between the Town Council and the Burrillville Extended Care Board of Directors.
Motion by Councilor Margaret L. Dudley. Seconded by Councilor Wallace F. Lees. The motion carried, six in favor, one abstention. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
17. Burrillville Housing Authority: Councilor Margaret L. Dudley was nominated as liaison to the Burrillville Housing Authority by Councilors Wallace F. Lees and John M. Karmozyn, Jr. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
18. Burrillville Industrial Foundation: Councilor John M. Karmozyn, Jr. was nominated as liaison to the Burrillville Industrial Foundation by Councilors Margaret L. Dudley and Wallace F. Lees. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
19. Jesse M. Smith Memorial Library Board of Trustees. Councilor Wallace F. Lees was nominated as liaison to the Jesse M. Smith Memorial Library Board of Trustees by Councilor John M. Karmozyn, Jr. and Margaret L. Dudley. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
20. Planning Board. Councilor Norman C. Mainville was nominated as liaison to the Planning Board by Councilor Wallace F. Lees and Margaret L. Dudley. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
21. Burrillville Recreation Commission. Councilor John M. Karmozyn, Jr. was nominated as liaison to the Burrillville Recreation Commission by Councilors Margaret L. Dudley and Wallace F. Lees. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
22. School Committee. Council President Nancy F. Binns was nominated as liaison to the School Committee by Councilors Wallace F. Lees and Margaret L. Dudley. Voting in favor were Councilors Nancy F. 23. Burrillville Senior Citizens. Councilor Wallace F. Lees was nominated as liaison to the Burrillville Senior Citizens Association by Councilors Margaret L. Dudley and John M. Karmozyn, Jr. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
24. Sewer Commission. Councilor Wallace F. Lees was nominated as liaison to the Sewer Commission by Councilor Norman C. Mainville and John M. Karmozyn, Jr. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
25. Zoning Board of Review. Councilor Kevin D. Heitke was nominated as liaison to the Zoning Board of Review by Councilors Norman C. Mainville and Margaret L. Dudley. Voting in favor were Councilors Nancy F. Binns, Margaret L. Dudley, Kevin D. Heike, John M. Karmozyn, Jr., Wallace F. Lees and Norman C. Mainville. Councilor Kevin M. Blais abstained.
