Are noise levels being negotiated to ensure noise levels be what they propose?

Response from the Solicitor:

The Town’s noise consultant is reviewing the “modeling” used by Invenergy to determine whether the noise the power plant would produce would be in compliance with our noise ordinance.  Our consultant is also independently doing his own calculations to determine whether Invenergy’s expert reports are reliable.  He is still awaiting the specific technological data that are required before he reaches his conclusions.

We are doing everything we can to have Invenergy utilize the most sensitive and up to date technological equipment to comply with our noise ordinance.  Our consultant has requested specific data so that he may reach an independent assessment whether the power plant can or will comply with our noise ordinance.

However, it is important to point out that our Town Noise Ordinance does not apply to a project such as this when the Federal or State governmental agencies have authority over this project. 

Further, the EFS Act provides that the EFSB, if it grants a permit, can override our noise ordinance.  Or, it can condition the granting of the permit upon Invenergy complying with certain noise conditions.
